Hi,

I am travelling soon to the US with VWP and I have a K1 process pending.

I am preparing some documents to bring with me in case at the POE they question me more.

I will bring a letter from my university and I was wondering if I need to bring a copy of my I129F and copy of the check cashed to show the officer that I applied for a fiance visa and I need to go back to my country.

Is this a good idea or the best is to say that I am visiting my boyfriend and don't mention the K1 Visa pending?

The a copy K1 isn't going to do anything. There is a possibility you could be refused entry but I have seen other posts of people being allowed in. I guess it is a ####### shoot

Personally, I wouldn't mention it unless specifically asked. Your problem isn't going to be convincing them you have applied for a K-1 visa, it's going to be convincing them that you intend to return home after your visit. A letter from your university would be a good idea, as would proof of any other commitments (rent, car insurance, bills, loans, etc).

It wouldn't do any harm to bring documents showing you have applied for a K-1, just don't rely on that as your only proof of your ties to your current place of residence. They may very well want more as you do have "immigrant intent" for the future.

There won't be any problem with returning to your country, they may not let you in the USA. Bring with you something which shows you will likely return to your country (the K-1 visa documents show you will likely NOT return) University documents are OK, proof of a job or property is better. If the officers at the point of entry are not convinced you will return, they will not let you in.

I travelled on VWP at Christmas with my K1 pending. Along with a copy of my itinerary showing my return flight, I took a copy of my lease and a letter from my employer.

I didn't mention the K1 as the question was not asked and was not relevant to my entry. (I felt) The officer processing my entry was a bit unsure of my entry, so I volunteered the employer letter and the lease, he asked to see the letter.

All else went smooth.

My letter from my employer included the date I was expected back at work and his full contact details if required for validation.

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

I am confused here, I thought we are to definitely say we are going to visit our fiance(e) in the US and have a K1 application pending and then provide proof that you plan to return???

Sorry for not getting this 100% but these two recent posts are confusing me?

Everyone advised me not to mention the K1 as it bears no relevance at this stage. In fact anecdotal evidence from others on the forum who have asked at POE have said the officers can not even see the K1 listed.

I did say I was going to visit my fiancé, just didn't mention the K1.

Having a US fiance most certainly shows that you have immigrant intent which is what you can be denied entry for. ;) Don't mention it unless specifically asked. If asked always tell the truth...misrepresentation is a much bigger issue for US Immigration than is being "allowed to withdraw your petition to enter".

With ESTA now in place for VWP Countries, I would assume being turned away will happen less but it's still up to the POE officer whether to let you in or not.

Just FYI.. being 'allowed to withdraw your petition to enter the US' and having to return to your home Country does not usually have a bearing on your visa. Unless you broke some laws or were legally deported (before a judge), It just means you can no longer visit the US because you showed intent. Ask me how I know... :whistle::lol:

My fiance (from the UK) was just over last week, and he had no trouble...but we did just file at the end of January. He got a letter from his employer stating that he has a contract that he needs to work through and so must return to the UK, but he said no one even asked to see it. He did mention to the officer that we'd filed for the visa, but they didn't really seem to care much. I think that, like with so much else to do with the government, it's really subjective.

Our Timeline

11/2001 - met online

6/2006 - first face-to-face meeting (he's been over 7 times total since then).

1/26/09 - filed I-129F with VSC

1/27/09 - package rec'd, NOA1 sent

1/30/09 - NOA1 hardcopy rec'd

1/31/09 - touched

4/29/09 - NOA2 email rec'd from CRIS! YIPPEE!!

5/12/09 - Mark rec'd Packet 3

5/29/09 - returned packet 3

7/12/09 - resubmitted packet 3 after being told for weeks that it was never rec'd

8/19/09 - interview scheduled for 9/11/09! Medical moved to 9/10/09.

9/10/09 - medical - passed

9/11/09 - interview - approved pending embassy receipt of medical results!!!!!!! Hard to believe it's finally done!!

10/2/09 - POE: Logan Airport in Boston, MA. Absolutely no problems, aside from the customs official not knowing what to do with the visa and having to find someone to help.

10/10/09 - Married!! :D :D :D

12/2/09 - SSN applied for in Montpelier, VT

12/7/09 - SSN received in the mail - that was fast!

1/9/2010 - AOS & EAD package sent

1/15/2010 - NOA's received for both AOS and EAD applications

1/22/2010 - biometrics appointment letter rec'd - appt is for 2/2 in St. Albans, VT.

It also has a lot to do with how often you've travelled to the US... how long your visits were/are... whether you have ties to your home Country... if you've spent more time in the US than your home Country... where in the US you are going... and what side of the bed the POE officer woke up on. ;)

I'm going over to visit my fiance next weekend (sorry.....i just have to do a little woooooooooooohooooooooo!!!!!!!!!) and I am taking the following things with me.

Copy of my lease

Copy of my return flight

Letter from my employer.

I am not telling them I am visiting my fiance. I am on vacation, visiting friends (which I am, as part of the trip is visiting my friends mark and julie so I'm not lying). I have heard from many sources here on VJ that they can not see your K1 application on the system whilst it is still stuck in a box @ USCIS. If your petition had been approved....this would be different.

If my petition is approved before I leave (DOUBTFUL) I would take a copy of the petition in addition to the above evidence.

As others have stated...it boils down to your POE officer, and as a lone female, i was concerned about being questioned on my first time in, but instead I got a very friendly male officer who commented on my curls and said i had beautiful fingerprints.

I hope I am as lucky next time.

I might have got lucky on my last trip. I was in the US from February to May last year, and then I went back in October for another three months. I was pretty worried about going through immigration at Newark, especially when I saw the immigration officer wasn't in a very good mood. He was shouting about how he had just sent 4 people in a row back to fill their form in again. When it was my turn though, he didn't say a word to me. He didn't ask where I was going, what the purpose of my trip was, or how long I'd be staying.

I think he was just glad to have someone who had filled their form out properly!
