Hi,

Somebody wrote answering to one topic:

"K-Visas for the most part get AOS approved without an interview because the visa has immigrant intent, and the visa has the added immigrant interview to get the K-Visa."

Is that true? Will we receive our conditional green card without the interview?

Nobody can tell you for certainty but very often a person who entered with a K-1 is approved without an interview at the local service center.

When we were filing for AOS last summer, I looked at the statistics here on VJ. At that time, it was about 20 to 30% that were receiving their GC without an interview. Recent data looks to be more like 35 to 40% are getting approved. Go to the "immigration timelines", select AOS Section "(Advanced View)", sort by decision date, then go page by page. Most that get transferred are the ones receiving a GC without interview.

Its kind of a ####### shoot. It seems that CSC does most of the approvals without interviews but there have been many who had interviews while being processed at CSC. The way the USCIS operates is a cosmic mystery :blink:

Don't know. It is possible, but I would say "not likely". I know of ONE of maybe 20 couples I correspond with that did not have an interview. We had one. That said, our interview was as painless and easy as they come. They did not ask for any evidence but I brought everything I had anyway. It sat on my lap. They never looked at anything, never asked to look at anything. They asked a very few simple questions, mostly the questions on the I-485 and that was it. It took 13 minutes total from when we walked in the local office until we walked out, approved.

My opinion on the matter, my thoughts? With the K-1 visa the purpose of this interview is to verify you have followed through with your obligation to get married and live as a married couple. The interview usually occurs shortly after the wedding, they have the marriage certificate with the I-485. There really isn't much question you have done what you need to do. It isn't enough time to get a divorce, I mean the whole thing is rather pointless. I would imagine the lifting of conditions filing could involve a little more scrutiny.
