I filed the form I-129F and was received February 2, 2006. It was approved by USCIS (Nebraska) April 20, 2006. The National Visa Processing Center approve my file May 4, 2006.

We are currently waiting for packet three, however, my fiance has yet to receive it. I faxed the American Embassy (Paris) to inquirer further about the situation. They wrote:

"In reply to your inquiry about the status of your fiancé's approved I-129F petition, the Department of Homeland Security, US Citizenship and Immigration Services is conducting a new procedure on all K1 visa petitions. Therefore, we have not received it yet."

Apparently the Embassy returned our file to USCIS (according to the National Visa Processing Center) May 25, 2006.

Do you know anything about this particular situation? Is it possible our file was lost?

It sounds like you may of been erroneously included with the IMBRA recalls. If your received or receipt date on the NOA1 is prior to March 6 this should not have occured. It seems to of happened with other members as well. Get in touch via email and phone with NVC and inform them of such, as well as the embassy. Also contact the NCSC and explain the situation as according to the FACT SHEET they can make enquiries to the service center and someone will get back to you. This should be done by the USC petitioner.

We were also approved after you and recieved packet three. From Paris. There's no reason you should have been recalled, I'd just keep calling and calling and calling until you find out what is going on. IMBRA is for those with noa1 recieved dates after march 6th from what I understand. Goo dluck and let us know how it goes.

PS- please update your timeline. It's REALLY vital in calculating dates and statistics for the site.

I would double check if I were you... It's a sad thing to say but those people HAVE NO CLUE what they are talking about.... It's almost like talking to someone in the government over here in the U.S.... you'll get different stories form every person you talk to..... For example....... I called my Consulate (Bogota) to confirm that they received my faxed instructions, changing my address and the mailing address of my fiance..... they told me they did not accept those types of things by fax, only by mail..... guess what happened two days later? Before my mailed request was even sent out of the U.S.? My fiance received his packet 3 at the requested address....... then yesterday, I get a letter form them stating that they had sent my fiance his packet 3, and guess what was behind it? A copy of my fax....... AND a copy of someone else's fax asking them questions about a totally different type of visa.... I certainly hope her fax didn't get lost due to someone's errors, but it sure looks like it to me........ anyway, it just goes to show you that they have no clue, tell you one thing, then so somethign totally different!!!! Best of luck, I would try again...... :)

6-16-05 - PACKET 4 RECEIVED!!!!!!!! Interview scheduled for July 14th!!!!!!!

7-14-06 - VISA DENIED DU TO LACK OF EVIDENCE

8-1-06 - Second interview - VISA APPROVED!!!!!!!!!!

9-29-06 - He arrived!!!!

10-19-06 - Married at a small ceremony

11-10-0 - sent AOS package

11-17-06 - RECEIVED NOA1 for AOS and EAD

11-27-06 - RECEIVED BIOMETRICS APPT 4 12-14-06 WOOOO HOOOOOOOOOO

2-1-07 - RECEIVED E-MAIL THAT EAD WAS APPROVED!!!!!!!

2-3-07 - RECEIVED EAD CARD IN THE MAIL!!! Lucked out on that one!!!
