Hi Guys. I am just getting started on the K1 process. My fiancee has an 8-yr-old son who we would like to bring as soon as possible in the process. I have failed to locate guides or relevant information on VJ. Is there such a thing? Could someone be so kind as to point me in the right direction?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I was on that page, but there is no K2 guide there. Am I looking for the wrong thing?

If you read the instructions for completing the I129F, there is a note on Page 1 that indicates "Unmarried children of your fiance(e) who are unger age 21 and listed on the form will be eligible to apply to accompany your fiance(e)."

Once the petition is approved, your fiancee will be contacted by the embassy and at that time you wil complete additional paperwork for the K2 child, as well as pay additional fees for the child. The VJ Guides do not specifically address this situation.

My son arrived on K-2... For the USCIS the child is named on the I-129F, that is all. The process at the consulate is essentially the same as the K-1 when it comes to application forms, medical, etc.... just the name on the application form is different.

Just list her son on the I-129 form and then she will need to get a notarized letter from the childs father stating that it is OK for the child to leave the country and live with the mother in the United States. Once your file goes to the embassy in Lima they will send instructions for your fiance and her son as far as needed physical exams, etc.. At the interview, the child will need to be present and then when approved, they will issue a K-2 Visa for her son in his passport along with the K-1 visa for your fiancee. Make sure you make extra copies of the notarized form that the biological father signs because they will take a copy at the airport and you will need one at your POE as well as for enrolling him in school. Let us know if you have any more questions and good luck with you journey.

Thanks. That is very helpful. I think it is starting to make sense. I assume that once the I-129F is approved and we get the checklist from the embassy, I will have a much better handle on this. But the info I have gotten so far helps a great deal.

Keep the cards and letters coming, because actual stories would be really enlightening (and any additional tips and info would be most welcome).

Hopefully, I will get a chance to pay it forward one day.

Good idea for extra copies but nobody at the airport took our notarized letter nor did they require it for school enrollment...
