Hi guys....

Can you guys please help me?? I honestly do not have time to read most posts on the website bcuz of my job......

I am about to send my I-129f out for my fiance in Colombia but now with all the IMBRA hoopla don't know if I should wait for a new form (whenever that may come) or just send out the whole packet that I have ready!!!

I ran across this "Draft" in the USCIS website and am wondering if this is an example of the NEW form to be coming out!!

I read the latest news from USCIS regarding the IMBRA but it did not specify about those wanting to send out aplications........

If I send it will I get the whole packet back?? Or just an RFE for the new requirements??

hello! as of now with all that is happening USCIS just announced that rfe's will be sent out to those paperwork whose NOA1 date is past march 6. if you file now. most likely they will accept your application, put it in their pile and eventuwally send out an RFE for your application as well. indeed they are in the process of finishing up the new 129F form which would comply with the IMBRA guidelines. we all dont nkow when the exact date of the new form will be finalized but if you check the old form, it has an expiry date of 6-30-2006 so i would assume within that time frame or by then, the new form will be released. i suggest that you might as well send out your application and have it filed and get the RFE. but if you can wait about a month or two then you can choose to go the other route.

this is just my personal opinion, as of this point, the release date of the new fiancee visa form is still in limbo but i hope this helps :)

Keep an eye out on the forum - it sounds like they may have just approved the new form. Your safest bet to be 100% is to check the USCIS site to see if they have loaded new forms. If you do want to file now with the existing form, chances are they will simply send you a new form to fill out and return - you wouldn't have to send back the entire package. If I were you I would wait a few days to see what happens - it might just save you a lot of trouble and anguish.

I'm in the same boat ..... ready to sail, but still tied to the pier.

According to the CNN story today it sounds like the "draft" for was approved in an "emergency" clearance (or something to that effect). I'm betting that it'll be available soon. And even it's another week or two, it's probably still better to wait for the new version than to file the old version and have to wait around for the RFE.
