You must follow the instructions on this page. However, to request the interview in Fairfax, make sure you clearly state that in your cover letter. Clearly state that you are applying under 319b which allows you to interview anywhere.

Oh, and also-- we want the interview in Fairfax. I am confused about where to send the application.

Thank you for that link. I guess that rules out sending it to the Vermont Service Center, but it still doesn't answer my question about which Lockbox address to send it to. I reside in MO, but want the interview in Fairfax, so which Lockbox should I send it to?

Also, I just read on another thread here that all 319b apps should be sent to the Nebraska Service Center, regardless of whether you are military or not. Any clarification on this?

Actually, all N400 apps end up in Nebraska in the end so you may as well skip the re-route through TX or AZ lockbox and send directly to Nebraska and mark the envelope with 319 (b) Naturalization. In the cover letter indicate your preferred field office for interview. Try including that new form G-1145 so you're notified of when they set up your case and you may consider emailing Fairfax office with your case number ahead of time - I think they have their email address listed somewhere.

Hello all,

I am trying to apply under section 319b since I have ties to the department of defense. I have a question regarding form N-400, part 7, section C (Time Outside the USA) - my wife is residing with me overseas, how would I annotate that if there is only a "Date you left the United States" and "Date you returned to the United States" in mm/dd/yyy format? Should I just put in today's date for "Date you returned to the United States" or present etc?

I have the same question! I just put "N/A" on the return date, and counted the days from the departure date until today as the number of days for the trip...but I don't know if that is the correct way to do it.

Step 1, #3 of the N-400 Instructions say "Answer all questions fully and accurately. State that an item is not applicable with "N/A." If the answer is none, write "none."

My lawyer wrote "NONE" under the "countries to which you traveled"

hi i'm a military spouse,my husband will be deployed to UK next march,the immigration officer here in TX told us to apply for citizenship under 319B,when i fill the form N400,i got confused about part 7,since i just got here in 2009(got my green card in 2010),I've only been living here for barely 2 years,what should i put in the blank,it doesn't make sense to me to count all the days outside of the US in 5 years? should i just leave it blank?

My wife arrived 11/2007, received GC 05/2008 and filed N-400 08/2008. Prior to this we had been out of the country a couple years. Despite this, on Section 7A, my lawyer wrote "0", on section 7B "0" and section 7C under countries to which you have traveled "NONE". That is because the instructions state these are only trips since receiving your green card. N-400 instructions for section 7 say, "Provide the requested information for every trip that you have taken outside the United States since you became a Lawful Permanent Resident. Begin with your most recent trip." Since you haven't left the country since receiving your GC last year, you should be able to write the same as what ours said.

I think my wife may be able to qualify for early naturalization based on Section 319b, but I'm not sure, and could use some advice. I sent the following message to a few immigration attorneys today, but I'd be curious to get the input of fellow VJ members...

"I am a US citizen from northern California currently living and working in the Democratic Republic of Congo. My wife, who is Congolese, was just granted a CR-1 visa, and we plan to enter the US in November.

I'm currently employed by a USAID contractor (not USAID directly), and my position forces me to be employed overseas. From reading through information relating to maintaining permanent residency status, I believe I may qualify to proceed immediately to the naturalization process with my wife based on the following conditions, according to the State Department: http://www.state.gov/documents/organization/79520.pdf

My wife is:

1) "Married to a U.S. citizen and living together in a valid marital union"

2) Will be "a lawful permanent resident at the time of your interview"

3) We can "show evidence that you will join your spouse overseas within 45 days of your naturalization," as she already lives overseas with me.

I am:

1) "A U.S. citizen “regularly stationed abroad” in the employment of:

- An American firm or corporation engaged in whole or in part in the development of foreign trade and commerce of the U.S., or a subsidiary thereof"

2) I will "have at least 1 year remaining on my overseas duty at the time of naturalization"

Given these circumstances, I am trying to determine if we have a valid case on this matter, and what is the likelihood of a positive decision in this regard."

Also, does anyone know if working under TRIPLE CANOPY on a US government contract makes us eligible for this? We are currently in kuwait. Thanks!

FYI, I got my citizenship a week ago. I applied from abroad with an approved N-470. My interview and oath were on the same day at the San Francisco USCIS office. Mine was an administrative oath in front of a USCIS official in his office.

Bottom line:

1. If you have an approved N-470, and have accumulated the required physical residence, you CAN apply from abroad.

2. When applying, you can submit fingerprints on the FBI FD-258 cards and save a trip to the US for biometrics. I did not do this myself as I was not aware this was possible.

3. The 90-day residence requirement is NOT for the 90 days immediately preceding the filing of the N-400. Basically, you should have resided in that district for that period at SOME time in the past.

4. USCIS takes the view that an approved N-470 preserves BOTH continuous residence in general AND residence in the last district you lived in before leaving the US. What this simply means is that with an approved 470, USCIS will consider you to be residing in that last district for ALL the time you are abroad right up to the interview and oath.
