at what point will my fiance not be able to enter on a visitor's visa?

Timeline

I have heard that at a certain point in the I-129F / K-1 visa process, my fiance will no longer be allowed to enter the USA on a visitor visa because USCIS doesn't want people to cheat and get married here without the visa being approved. Has anybody had any experience with this, and can you tell me about how far into the process they'll stop letting him in? He's coming in 2 weeks for a visit, but we're hesitant to plan more visits if he's just going to get turned around in Boston when he lands!! :(

Our Timeline

11/2001 - met online

6/2006 - first face-to-face meeting (he's been over 7 times total since then).

1/26/09 - filed I-129F with VSC

1/27/09 - package rec'd, NOA1 sent

1/30/09 - NOA1 hardcopy rec'd

1/31/09 - touched

4/29/09 - NOA2 email rec'd from CRIS! YIPPEE!!

5/12/09 - Mark rec'd Packet 3

5/29/09 - returned packet 3

7/12/09 - resubmitted packet 3 after being told for weeks that it was never rec'd

8/19/09 - interview scheduled for 9/11/09! Medical moved to 9/10/09.

9/10/09 - medical - passed

9/11/09 - interview - approved pending embassy receipt of medical results!!!!!!! Hard to believe it's finally done!!

10/2/09 - POE: Logan Airport in Boston, MA. Absolutely no problems, aside from the customs official not knowing what to do with the visa and having to find someone to help.

10/10/09 - Married!! :D :D :D

12/2/09 - SSN applied for in Montpelier, VT

12/7/09 - SSN received in the mail - that was fast!

1/9/2010 - AOS & EAD package sent

1/15/2010 - NOA's received for both AOS and EAD applications

1/22/2010 - biometrics appointment letter rec'd - appt is for 2/2 in St. Albans, VT.

so, in other words, what they're saying is that it's pretty much a case-by-case basis, and there's no real way to know for sure until he gets over here and goes through customs. That really sucks. I think I'll have him have his employer write a letter as proof of employment or something so that he's got it with him, just incase they give him flack.

One option I like to tell persons from UK, is to make see about traveling through Dublin or Shannon IRL, US CBP preclears travelers there, if they decide to deny entry to the USA, it will happen there, MUCH closer to home.

He flied from Manchester UK to London, then London to Boston. Do they not do the same thing if he's connecting in London?

Admittance is at the discretion of the CBP. No magic point in time but the totality of the facts and circumstances as determined by the CBP officer.

No, only those two ports in Ireland do this.

i have just got back from the usa, i went on a weeks visit the immigration people asked me how long i was there for asked the same question 3 times.. if i have family and friends in the usa, i said yes, i know lots of people.. then asked me what i do for a living i said.. and they stamped my passport and said enjoy your stay!!! and that was it... take as much paperwork as you can to prove you are coming back..pack light, dont stay too long and you should be fine..

I have been to see my SO 3 times sice we filled for the K1. Each time I went thru the Buffalo NY POE it has gone something like this

Where are You From?

Where are You going?

How long will you be there?

Where did you meet?

What do you do?

When do you expect to return?

What are you bringing in the country?

When was the last time you were here?

Because I am from Canada I dont need a vistor visa to enter the USA but I am sure if you can provide sufficient evidence that you are planning to return to your home country there is nothing to worry about. I usually bring a copy of my flight itinerary and a copy of my school schedule and they have only ever asked to see my itinerary, nothing else, Well the last time the boarder guard guy did make fun of me when I said I met my SO in World of warcraft, I loled at him because he didnt know what WoW was and said " girls play video games too" .

For documents, provide whatever is needed for you to enter the US, ie passport for VWP or visitors visa. They wont have a record of your K1 in their computer. There is absolutely no law that states you can't visit during the K1, in fact the UK embassy clearly states that you can visit at the discretion of the immigration official. I don't know why people make up the ####### you can't visit.

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
