my mistake on work application (EAD)

Timeline

My K-3 spouse filed her I-765 for EAD after she filed her I-485 for a greencard. On her I-765, she entered "a-9" for eligibility category on Line 16; however, she should have entered "c-9" instead - which, because of the difference between the two, she filed at the wrong office as well. She has received a I-797 stating they received her application and waived the fee because of her pending I-485, and that she will be informed of their decision regarding the I-765.

Should we notify them of the mistake ("a-9" s/b "c-9"), or should we leave it alone? I would hate to have to pay a $340 filing fee in case the I-765 has to be refiled after she has received her greencard.

More than likely they will send the I-765 to NBC in Missouri for EAD processing.

Some K-3's file an I-765 for EAD to get allow them to work and to delay filing the I-485 for AOS until closer to 2 years of marriage, the reasoning is that if the AOS is approved AFTER 2 year of marriage, they will skip the 2 year conditional green-card and get a 10 year un-conditional green-card.

The fee for I-765 is less than the fee and hassle of filing an I-751 to remove conditions from the 2 year CR-Green-Card.

I am sure they have corrected it (since they noted you have an I-485 filed). Additionally, once she has received her GC, the EAD is not necessary as LPR's are allowed to work (no EAD required).

Edit: Just looked at your timeline - see you have your interview on Feb 9. Should get the 10 yr GC assuming all goes well. I'd drop the I-765 since it won't do you much good at this point.

My understanding is that an EAD is required in order for her to get a SSN. Likewise, we have applied for EAD's for my step-daughters in order to get SSN's for them too.

Can apply for SSN using a green-card, in fact SSA requires you to report immigrations status change from NON-Immigrant to Immigrant when you do get a green-card, they will then remove the "With DHS Auth" notation from the SSN card.

G Green-card is Employment Authorization too.

Glad everyone is so confident that the USCIS will correct it for you. I have never seen one corrected yet on this site. Even though they know its wrong, they will summarily deny you and you have to re-submit. I would seriously doubt that they are authorized to make changes to your application.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I forgot to put "c-9" on my husband's I-765 (very important go check over things)...he received the EAD card anyway.
