I included my 2008 return as well. mailed the return off Monday so hopefully it gets to IRS before my I-864 gets processed at NVC.

If you mail the 2008 taxes you need to include the W2 and the 1040 apparently - someone on VJ got a RFE because they submitted only one part of it and said it's better (if you have not filed 2008 yet) to leave it and include 2005, 2006 & 2007. Now they are stuck waiting until they do their 2008 taxes and can produce the other doc for NVC. Just make sure you have the full set if you're sending 2008 to avoid any RFE!

To (hopefully) avoid that problem, we sent in 2007, 2006, 2005 transcripts. I will let everyone know if they ask for more information so others are prepared.

My husband has his W2 but cannot file until he has all of his tax slips. Some come from Canada (he is both a US and CDN citizen and has investments in Canada) so he normally cannot file until after March. I really hope we are not held back by this. We did include pay stubs for the last 6 months so I am hoping that is enough evidence of 2008 employment. Otherwise I guess we would just send a copy of the W2 and explain he hasn't filed yet.

It just doesn't get any easier does it? :wacko:

Someone on VJ posted that since they sent the 2008 W-2, they got an RFE for the tax return. Since its way before April 15th, you should submit the 2007, 2006, and 2005 records(that's what I will be submitting), and take the 2008 information with you to the interview, if asked, you can present it.

Jaqui - What documents were required for the ITIN? My accountant told me I couldn't apply for an ITIN since my wife is not here, but the instructions for the W-7 indicate that I can apply for it.

I hear you; we are not planning on sending anything extra unless they ask. Actually I believe that the filer that had the W2 issue ended up getting their case completed before they sent in additional tax info. Does NVC really know what they want? I found that thread a bit confusing.

Let's hope we all get through this stage soon so we can let others know.

Does NVC really know what they want?

This is a very good question! Let's just hope we all get through based on what we know! Haha! I am still amazed about the RFE's on photos that people get - some with pen get passed, some with pen do not, some with "felt tiped" some with pencil... as long as it's neat, easy to read, doesn't smear etc you'd think they could do what they need to do with them!! I am sooooo glad we have this website!!

My AOS package was generated 2/07 but I have not yet received it, hopefully today.

For ITIN all we needed was his passport. The difference here is we are doing consular processing and will apply for a waiver since my husband EWI.

The IRS required for my wife (Philippines) to submit a certified copy of her passport bio page, her birth cert. and our marriage certificate. All had to be certified copies from the issuing agencies. along with the completed W-7 form. I just included this is my 2007 tax return and they forwarded the W-7 to Tx.
