I was wondering would people just get married overseas and pursue CR-1 on the I-130. Since I have seen nothing about IMBRA affecting this visa route. That is what I am reading--right? That only the I-129F is governed by IMBRA. And god how would you determine if you met your spouse through an IMB? I mean the definition is so vague--technically your ISP is an IMB since you pay to have Internet access and you are then facilitated by that access a communication route with foreingers.

Thank god my wife is here already and I am done.

Yep, the CR-1 is sure looking the more viable nowadays. Even prior to the IMBRA it has been level pegging timewise against the K visas in some cases and not too far behind for many others. It sure has put a spanner in the works for ease of processing and no telling how much extra time the new requirements are going to add to the overall process. We met online....NOT a marriage broker site, but there was a fee if you chose to be a full member. I imagine it is going to cause a bit of confusion and open to interpretation as to whether sites are classed as marriage brokers or not. I dont envy anyone doing K visas right now.

Well, if I understand everything right, it does not matter whether or not you used a IMB. You would be only be affected if you were just starting a relationship using an IMB. At that point you would have to surrender personal information such as your criminal record, divorces, and if you have previously filed a K1.

Since you are now at the stage of filing K1, you will have the extra police check the same as everyone else. The major malfunction causing the delay for K1's related to IMBRA is the new form was not ready so everyone has to 'reapply'.

If you are starting a K1 now you will be behind the 'backlog' of people who will be 'reapplying'. In that way IMBRA will delay your processing, as well as the 'extra' police background check. However, it is still possible a K1 will not be any slower then a K3 at this time. There is many other factors in becoming eligible for a CR-1 or direct consulate filing that I do not really understand, however, so maybe that would be faster if you qualify.

AOS Process a fading memory...

01/31/07 - Mailed AOS/EAD package for Olga and Anya

06/01/07 - Green card arrived in mail

Removing Conditions

03/02/09 - Mailed I-751 package (CSC)

03/06/09 - Check cashed

03/10/09 - Recieved Olga's NOA1

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

Agree it would be difficult to prove whether you met via a marriage broker or not. Everyone that would have typically met through a marriage broker, will just go to free sites, marry and apply for the CR-1. Seems like a big loop hole was left. Betting someone somewhere someday will fix that as well. :yes: Just glad we missed that lubberly circumstance.

CR-1 isn't really any more difficult that the K visas you just provide more info from the start vs later on in the process, and it takes a bit longer.
