Yeah i was just curious if my Fiance who lives in America has to actually be in America when she sends away the I-129F form and G-325A forms etc when she be's my petitioner for my K1 visa?

Or is it ok if she is with me in the UK, we fill in the forms together in the UK, then send them to here home address in America? and then her Mom sends them to the USCIS?

Is that ok or will they know shes not in America and it will be void?

no, however US domicile and financial support ability will eventually come into play down the line

You can actually send the file directly to USCIS from the UK rather than having it stop in two places if you'd prefer to save postage. Just make sure that you are sending the file to the USCIS Service Center that deals with cases from her state. As long as her permanent residence is the USA, it does not matter where she is when she sends the packet in. The reason that people normally go back to the US to send their files is because they have to have a copy of their original birth certificate and other original proofs that they don't have access to abroad. However, as long as she has access to everything she needs there in the UK, there's nothing that says she can't file while she's there with you. Good luck :)

Hey I was in UK when we sent our petition. I just sent it straight from england. and i had no problems at all!good luck!

OUR TIME LINE <3

[*]met in New Zealand april 19th 2006

[*]kevin came to new york for 3 weeks dec 2006-jan2007

[*]chelsea went to england for 3 weeks may 2007

[*]kevin came to live with me in ny for 6 months july 2007

[*]chelsea went to live in england jan 2008 Nov - 2008

* CHelsea moves back to USA.

* Kevin Comes To NY for the holidays December - Jan

* waiting for the interview date So I can go to england for it!

Wedding - JULY 30th 2009 so excited!

[*]sent application to vermont service center july 15th 2008

[*]NOA1 Aug. 5th 2008

[*]NOA2 APPLICATION APPROVED 11/28/2008

* Medical 1-26-2009

* waiting for visa date
