My wife and step-son recieved a 2 year Permanent Resident Card, so we're filing the I-751 for the 10 year card. I am a little chagrined because I followed the 90 day lead time which was the standard.

It appears from the B2 customer information flyer that you can, "If your Permanent Resident Card is valid for only 2 years, you are

a conditional resident. You will need to file a petition to remove the conditions of your residence before the card expires. You may file this petition up to 6 months before the card expires."

That's nice, given that the web site says that it takes 9 months for an I-751.

We wish to return to China for vacation. Since their Permanent Resident Card will have expired, will the card and whatever paperwork sent to me stating that the request is being processed be adequate to go out of country? My research tells me that a Travel Request isn't necessary because our intention isn't to stay out of country for a year or longer.

The Notice of Action that you will receive upon the submission of the I-751 act as a one year extention of the greencard. You will carry the expired greencard and the extention letter and present to the POE officer upon return to the USA

That's right. You will receive a Notice of Action, I-797C which looks like just a notification that they received your application. However included in the body of the letter is a statement extending the conditional status for one year. This is an important document for travel purposes so guard it carefully. Also, the receipt number on this notice is of no use to you. You can not track this case with that number. The case number for tracking purposes will come with the notice for biometrics.

It probably depends on where you have to file how long it will take to process. We filed for my wife in May 2008 and she received her permanent card in late September. The best thing is to be well organized and have good documentation to submit.

I'm just now sending off the application for my stepson. He had a different expiration date for his green card since he arrived 8 months after his mother. :yes:
