I-130 Approved, & Nat'l Visa Ctr. fees paid

Hello Everyone,

I was married in Brazil where my wife is a citizen and currently lives. Our goal is to have her living with me in the USA with a greencard to obtain citizenship.

I filed for a K3 and sent my I-130 with supporting documents in March 2008 to the Vermont Service Center. They expedited it to a California office after a long wait, and was approved. Then, I received a notification from the Nat'l Visa Center in New Hampshire; and now they have my information, paid fees, and my wife's "Choice of Agent" form.

I have some questions about the I-129F:

1) Should I still submit my I-129F for the K3?

2a) If I do not send the I-129F, could my wife interview for a CR1 visa instead of the K3?

2b) How will the visa center determine which visa (K3 or CR1) to pursue? (Since I applied for a K3, but didn't send the I-129F)

1) No, once the I-130 has been approved, it is too late to file the I-129f as no action will be taken on it

2) The I-130 is a petition for the CR/IR visa.... With only the I-130 filed your wife has no choice on the visa type... it will be CR/IR

3) Since they have only one petition.... there is no choice as there is only one path.... FWIW, you did NOT apply for K-3 as no visa has been applied for yet. It will not be a K-3 ever, since no appropriate petition was submitted for eligibility determination.

be happy u didn't submit the I129F when was time for it. would have only slowed u down at Vermont. and for those who submitted both I130 and I129F, they were approved same time anyways.

if u already started yr NVC process, go on with it for CR1. is the visa that offers what u wanted from the beginning anyways.

I 130 NOA1: 20 march 2008

I 129F sent: 11 april 2008

I 129F NOA1: 11 april 2008

I 130 and I 129F NOA2: 12 dec 2008

NVC process:

NVC received and assigned case number for both: 18 dec 2008

(break in the process- Lee comes to spend holidays here 22 dec-5th jan 2009)

DS 3032 generated :? ?

DS 3032 sent : 26 dec 2008 (friend sends it, based on how fast Ds-3032 was generated for Sracastillo and others who had same NOA2 date as me-risky, but worked)

received AOS package and IIN number in mail : 29 dec 2008 (same friend picks up mail and sends us the IIN)

pay the AOS bill online: 29 dec 2008

AOS shows as PAID: 30 dec 2008

my husband goes back and bags with our papers get lost : 5th jan 2009

package IV fee bill generated and paid online: 7th jan 2009

recieved bags and papers: 9th jan 2009

sent AOS package: 9th jan 2009

package IV bill shows PAID and sending package IV : 12 jan 2009

case complete: jan 20th

interview march 30th 2009

I129F

NVC mails I129F package to bucharest embasy

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless
