Timeline

My K-3 spouse has applied for an EAD. My K-4 step-daughters are ages 11 and 15. Once my spouse has an EAD she may apply for an SSN. What about my step-daughters.... Do they need an EAD in order to get an SSN - Do they need an SSN - what or how do they get an SSN if it is necessary?

Only persons age 12 and older must apply in person. A derivitive visa beneficiary (K2 for example) may

elect to have their parent (the K1 for example) apply on their behalf (they will still need all the required

documents). The SSA will most likely need to verify the validity of the EAD and will make a copy to send to the USCIS as part of the SSN processing. Once they verify the EAD you will receive your SSN card in the mail.

They will need to provide an EAD card to be assigned a work authorized SSN, so unless they will be making sweaters for Wal-Mart, just apply to IRS for an ITIN if you need a number to file taxes. Then once the AOS has been approved and they have either an I-551 stamp or card, you can apply for the SSN.

The parent applying on behalf of a child also must provide proof of his or her identity.

However, a child of any age can sign and submit his or her own application.

Applicants age 12 and older must apply in person at an SSA office, even if a parent has signed the application.

We went ahead and applied for EAD's during AOS filing for all of Rin's children last summer so that they could get SSNs (they were K-4 status). This was due to the tax rebate requirement that a SSN for each dependent was required to get the tax rebate. If you don't need one for a specific purpose, then I suppose waiting until the GC is received would be sufficient.

Also, filing taxes with a W-7 (to receive an ITIN) will require a hard copy (no electronic filing) and will add several weeks to your tax return processing (ours took an extra three months for TY 2006 when we filed with an ITIN request for Rin).
