passport and visa name on I-765

Timeline

I am sending in her I-765 and her I-864. We just got married and I used her new name on the forms, but just realized her name on her visa and passport are different. Will this be a problem? what do I have to do? I only have a couple weeks before her visa expires and wanted to send the package out right away and I don't no how long it will take to get this changed.

We used Claudeth's married name. When her passport expired we got her a new one with her married name.

Degrizz, I am in the identical situation as you. I used my wife's new name on all the forms. and I read thru the USCIS publications and instructions. This is not a problem if you included a copy of the marriage certificate in your 765. And I also mentioned it on the cover letter like this "Please note that XXXXXX XXXXX entered the USA under her maiden name, changing her surname after marriage as reflected on Cert of Marriage". we should not have a problem at all. I will let you know how it goes for me.
