Hi all,

May I know who is eligible to apply for a SSN?

We filed the I-130 and I-485 package along with the work and travel document application in December. Just got our first NOA and have a biometrics appointment scheduled in mid-January. My I-90 has expired though. Should I have sent in the SSN application with the I-130 and I-485? Am I eligible to apply one now? Any input would be appreciated!

You are not eligible for SSN until work authorized.... (I-765 approval)

USCIS does not process the SSN application so including it would have been worthless... Once the I-765 is approved you need to go to a SSA office

Once you have the actual document (I-766 or I-551) in your hand you can go apply for an SSN. SSA will not accept the approval notice in place of the actual document.

You can obtain the address and directions to the nearest Social Security office from the Social Security Office Locator, which is available on the Internet at:

Note: Applicants who live or receive mail in the Brooklyn, NY, Queens, NY, Phoenix, AZ, Orlando, FL, Sacramento, CA or Las Vegas, NV area MUST apply at one of the Social Security Card Centers.

My spouse on a K-1 visa applied for a social security card in California within a week of arriving here and

it was in the mail in a week.

We weren't married yet and it had not authorized to work until EAD, but at least he got a number right

away. I don't think you have to wait.

Wrong. First of this person did not enter as a K-1 and I assume has filed for AOS from another immigration status after getting married while in the United States.

To be assigned an SSN the person needs to provide an employment authorization document, i.e. I-766 or I-551 and SSA has to see the actual document, not a filing receipt or approval notice. So until they have the I-766 or I-551 in their hand, yes they must wait.
