Timeline

hi there!

I have a simple question and never thought it would be so hard to get a straight answer!

I received my advanced parole and was so happy that after many years I would be able to go home for the holidays, I entered the US with a student visa, overstayed it , met my husband applied for my papers on August, already got my EAD and the parole, I'm just waiting for the interview...but now I'm not sure if Ishould travel or not... Some people say it safe they had no problem, some say I should not... the only thing I dont really understand is... What is the point to have the advance parole if you cant travel? why would they give a such thing if you cant come back? Please i would love to hear from people that actually knows someone, or traveled using this parole! My husband is coming with me, but he is returning before me! I will be alone, and I'm not sure what to do! Thank you all!!

I remember reading somewhere that says it is not recommended to travel before GC is granted if at any point there was unauthorized stay, even you have the advanced parole. I do not have personal experience though. It may entirely be fine in reality.

thanks... I read many times, that I shouldnt go, jus like I read many times I shouldnt have any problems, not sure what to do still!!! lol

I would wait for a GC to arrive, unless it is an emergency. Friend of mine with AP was stopped in Miami after arriving from Aruba and was questioned and not released for several hours, she had to miss her connecting flight home.

What is the point to have Advanced Parole approved If You can't travel. I think that sometimes we all get questioned at the airports even with green cards. I think you can but just to be on the save side and feel more secure just ask an attorney and go enjoy your country! :)

What is the point to have Advanced Parole approved If You can't travel.

I think the point is people don't have a proper visa or a green card yet. So the document allows the officer to parole you to the US without the normal entry documents. But it is the officer's decision whether you are admissable. If you're a K1 with no problems in the past, then it should work. If you have overstays on a non-immigrant visa then the officer may take that opportunity to keep you out of the US.

The document only says you are processing AOS and may be allow to enter the country to continue that process. It doesn't say the officer can't find you inadmissable at the POE if he finds reasons.

I think your husband has to file a spousal visa petition and go through the process of getting a K3 (or CR1) visa to enter the US. It's like starting over...fees, months of waiting, interview at Embassy in your country, medical exam, etc.

Some people just don't want to risk that if they think there is reason they could be denied....like the overstay.

My wife and I married with our K-1 visa before it expired. We did not file for our AOS till about 5 weeks after her K-1 visa would have expired. Does this constitute in any way an overstay with the difference between when the K-1 WOULD have expired and when we finally filed our adjustment of status application?

My wife has advanced parole and is leaving soon. I hope she can come back? Any reason why she wouldn't?

I just wanna to let everyone know, that I did travel using the AP and had no problems... !!!when I got back they sent me to a little office and stamped my passaport and my I 94... no questions asked.!!!

Hi! Just like kkkathyca I left the USA with the AP. I went home for a month and had no problem getting back in. If you have overstayed your visa for more than 180 days before you filed AOS then you SHOULD NOT leave since they might deny your entry.
