PUSHBRK, as mentioned earlier, I do not know why, how, or what the reasons are, but JFK is giving K3 VISA HOLDERS work authorization stamps at POE. K3, not K1. We can go back and forth on this topic about procedural layout but it is what it is in practice.

**** filed K3/CR1 concurrently. My wife and I both work/live overseas. The following timeline continues from the approval of the K3 VISA.

I've seen no such report. K3 is not work authorized. K1 is.

Seems like the work stamp is kind of a moot point. From what I have seen on this site, the work stamp was only good for 90 days. So what do you do? No way your AOS is gonna be complete in 90 days. Work for 90 days, and then quit? I have also seen employers that don't like the stamp. They want to see a green card.

I guess the CR-1/IR-1 vs. K-3 thing will go on forever. Just look around though. Many people have come on K-3 and wished they would've went the CR-1/IR-1 route. Kinda sucks sitting around watching All My Children all day with a K-3 visa, but hey you have that choice. That's the nice thing. Do what you think is best for your situation.

Note:

There's also a link that detailed every step from the time of petitions filing, and method of filing, even wordings used for the preparation of the petitions. Anyways, the point of my posting is that the EAD is not at all important in our case. WE have no plan for such thing or even a greencard for that matter until near our 2 year anniversary.

The 90 days allows you to get an EAD processed, not a green card.

JFK is giving K3 visaholders work authorization? Is that based on some lucky individual who got an inadvertant stamp by an immigration officer who wasn't paying attention.

It seems I did hear one such report. I suspect the CBP officer wasn't paying attention. It happens. They didn't even take the sealed brown envelope from my wife and stamped her passport and I-94 with August 39 as the entry date. The stamp would have been meaningless, as K3 is not work authorized.

Using the VJ timeline function puts the data into the database where it is used as part of the averages to predict the timelines of others. Check it out. Check anybody's timeline and scroll down to the predicted petition approval dates.

Just about every step of our k3 journey was not average. We received both our petitions approved in about 60 days. We then received our k3 interview very shortly after that..not weeks or months average. We also had both our petitions forwarded to NVC on virtually the same day. Not exactly average. Our k3 interview took about five minutes. When did you meet? What is your husband's sibbling's name? That was it.

Not exactly average.

I will look at the timeline later for funsake but based on our speed and experience from filing date, I don't give much credence to the accuracy of average. The claims about k3 visa being approved are not isolated. You can search VSJ for multiple cases of this happening. Personally, I don't know if its true or not. In all honesty, we dont need to havce a work permit or greencard any sooner than two years.

Let's see what happens and I'll be sure to detail for future VSJers.

Our timelines are similar but nearly three years apart. Neither would be considered an "outlier". The more data in the average, the more useful the average but I'm not sure how far back they use data to calculate the averages. I was just answering your "why" question.

My timeline was the fastest reported on CFL in 2006 for a K3 (by 2 days) and within a few days of the fastest K1. I forgot which direction. But that's for China. Lot's of K1 timelines for Europe were much quicker.
