I-130 almost done, need minor kids to come

my husband filled form 1 130 approved and in IR-1 category now and my interview should b in month and half how do i bring my two kids r what do i need to do. we thought that they was part of that application but i found out when i called immigration that IR-1 is just for me...What should we do, Please help!

If only an I-130 was filed and you're going the IR1 route, you children cannot obtain visas with you. They would need their own I-130 approved for each, to obtain IR2 visas. The K3 route allows them to apply for K4 visas with you, then they'll need their own I-130 to adjust status.

Are you on the K3 path or IR1 path? Were I-130 petitions filed for your children?

Yea I am in IR-1 route now but my hubby never filed for K3 and never filled separate I-130 for my 2 minor kids, we just found out that just me for that petition, now I need to know if how can I bring the kids with me, is it too late to file I-130 for them now?

It's not too late to file but if you wait for it to catch up, your own visa will be delayed. Those are sometimes the breaks though. Unless you want to leave them behind for a few months those I-130s need to be filed. It is too late to file the I-129F for the K3/K4 process. It has to be filed before the I-130 is approved.

Thank you very much for that relieving respond, 1 thing I wanna ask if immigration lawyer can possibly get their case faster so they can come with me, and if I have to go ahead of them while their I-130 still on the process when they are scheduled for the interview in the embassy can they appear in there but themselves or of course i will let my brother or sister for example to accompany them during the interview or do I have to come back here to with them during the interview or would it be better if my husband be the one to go with them, am sorry if am confusing I am confuse myself too with all this process.

I am new here, I really don't know whom I am addressing this message but I wanna say thank you Sir/Ma'am, your replies comforts me, Thank you and may God bless you!

Then they obviously can't go alone. I would discuss the potential escorts with the Consulate when you interview. Generally, US Citizens are not allowed in the interviews but you or a close relative probably will be acceptable. With an immigrant visa, you will have no limitations on travel back to accompany them.

there were questions in the forms about yr kids, and if they will join u at this time or at a later date. did u mention them there, as possible immigrants? i am sorry to say, but might be yr kids process will take as long as yrs. fact that a pregnant woman or with a new born is waiting for months to be approved doesnt make the visa to come faster, so I am afraid that u leaving yr minor kids home alone wont impress them either. or maybe they dont even know whats the case until it gets on their desk, and thats is in months from the aplication. i wish u all good luck and patiece, seems yr journey will still a while.

(break in the process- Lee comes to spend holidays here 22 dec-5th jan 2009)

DS 3032 generated :? ?

DS 3032 sent : 26 dec 2008 (friend sends it, based on how fast Ds-3032 was generated for Sracastillo and others who had same NOA2 date as me-risky, but worked)

received AOS package and IIN number in mail : 29 dec 2008 (same friend picks up mail and sends us the IIN)

pay the AOS bill online: 29 dec 2008

AOS shows as PAID: 30 dec 2008

my husband goes back and bags with our papers get lost : 5th jan 2009

package IV fee bill generated and paid online: 7th jan 2009

recieved bags and papers: 9th jan 2009

sent AOS package: 9th jan 2009

package IV bill shows PAID and sending package IV : 12 jan 2009

case complete: jan 20th

interview march 30th 2009

I129F

NVC mails I129F package to bucharest embasy

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless

Yes and we put that they are coming with me and not on a later date thats why we presumed that they was part of the application like the K1 before thats why I am freaking out now coz we found out that my husband have to apply separate petitions to each of them while mine is about done and I dont wanna leave them, my husband never got the DS-230 from yet to be sent to NVC i might tell him wait for few months before sending it so i can wait for them...what else other than their birth certificate and our marriage certificate for supporting documents...thanks!!!

...and one thing thats a stupid thought that my kids would be "home alone" if in case ihave to leave them coz my visa will expire if i wont go, I have my mother and sisters who are like their parents too...so they will never be "home alone" thank you very much.

Just to let you know, I am in the sme boat as you. My step-children are 4 months behind my wife, with the !-130's. Her application was just finished at NVC and will be on it's way to the embassy in Bogota. She will have to leave our boys with a relative, while the process proceeds. However! We will miss them very much. But, it will give my wife and I a little time to catch up and bond back into a loving relationship. We need that very much at this point, as it has been 6 months of longing to be with each other. Even the phone calls and computer, do not make up, for a touch . That is the way we are looking at the situation. I wish you well.

If everything goes right you will get your visa and go to the US. You should get your 10 year GC in about a month after arrival. You can then go back to the Philippines and take care of the kids medical and interviews.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
