Hey,

a friend of mine is not any longer happy in her Marriage with her Navy Man..It was a huge Wedding everything, but now things set her to make the final step..

But there is one thing she is concerned about.

Since she is German and she was brought by him into the states,..when is she able to stay and work in the states without being send back ?

The answer really depends on her current status (does she currently have a valid Green Card/Permanent Resident Card)? (to start with)

does she have a greencard?

If so, when does it expire?

YMMV

sounds like that's all she really wanted, green card.

and you know this how, exactly?

Nope thats not what she wanted.

HE confessed that he is gay.

She is totally shocked about the situation and doesnt know what to do.

She has the Green Card I guess for 3 years, the one you get after you get into the states.

She lives now one year with him the in the states.

No permanent Greencard yet...

Dunno how to explain, because I have never been in this process.

there are only two kinds of greencards.. a 2 yr. card or a 10 yr card.... either one you can get when you enter the states based on individual facts and circumstances.... the proper advice will vary greatly based on which card she has

YMMV

Does he want to stay married to her? Does she want to stay in the US?? Since he is the one who entered the marriage fraudulently, maybe he will stick it out until she gets her 10 year GC. In order to help her out. Can they get along? Or do they hate each other?

She isnt the most clever one when it comes to the internet :) so she asked me to ask here..

Yeah payxibka thats my question, when can she get divorced without any huge effect on the removing of conditions ?

So that the chances are high to stay in the states

she can divorce anytime... the burden will always be on her to prove that she entered the marriage on "good faith"...

YMMV

Where can I read more about the removing conditions ?

Or about her bringing evidence ?

So just for understanding and breaking it down real quick:

It also could be just two months of marriage, but it would be maybe difficult to proove that is was good faith

You can start in the USCIS.gov web site look for form i-751, it has information about the cases where you can apply for removal of conditions and what documents you need to support the application.
