Hello everyone , I am confused about the k3 route, Please explain it to me. My question is. What if I will not get the visa for k3? Can I just wait for the CR-1? My understanding was that if I will get interviewed for K3 it means that the CR-1 will no longer be my category?? PLEASE ENLIGHTEN ME GUYS> THank you very much! Good Luck to all of us!

How far are you along in the process? the thing is, if the I-130 gets approved before your interview date, USEM will drop the K3 in favor of a CR visa.

Hi, as far as I know, K3 visa is given to those spouse married for more than two years and CR-1 visa for spouse married less than two years.

Hi, as far as I know, K3 visa is given to those spouse married for more than two years and CR-1 visa for spouse married less than two years.

The K3 visa is a spousal visa that brings the spouse into the US on a multiple entry visa (for 2 years). The K3 visa holder must then apply for AOS/EAD.

The CR-1 visa is for people married for less than 2 years. The spouse will enter and receive their GC without having to apply for it, and can work pretty much immediately.

The IR-1 visa is the same as the CR-1 visa, except that it's for couples that have been married for longer than 2 years.

The K3 visa was essentially created at a time when the other spousal visas were crawling as far as getting approvals. They tended to be approved faster, so spouses could come to the US to be together while waiting for the CR/IR-1s to get approved. Now, it's much better to just go for the CR/IR-1s, because the approval time is about the same, and the CR/IR-1s come into the US way farther ahead of the game.

Not necessarily so. Trinidad-Lohner applied both for a K3 and CR-1 visa. She just got her K3 visa last week.

The main advantage of a K3 visa is that you have to file an AOS ($1000) but is much faster to process by the NVC. The CR-1 route provides you with a conditional green card but is much longer to process. It all depends on your priorities - to be with your husband immediately but with more documentary requirements or vice versa.

well the k=3 takes longer to process then the cr-1 if you concider the aos process involved and the fee is 1010 usd for that. the cr-1 is a much better visa and you dont have the stress when your spouse gets here to for all the paper work for aos and if your wife wants to work she can the next day if she wants with aos it would take 3 to 6 month before she can work if wanted

when you go to interview if it is for the k-3 ask if the papers for the cr-1 papers have come in and most time consulor will just switch if they did good luck

Quite true. But the advantage there is that both of you are already together. The additional wait times and costs become moot compared to both of you waiting while separated from one another. I guess the costs of being together while finalizing your papers is priceless. Do note that according Trinidad-Lohner, the USCIS allows you to file for both at the same time which was what she did. Her case number for CR-1/IR-1 already arrived but her K-1 visa already arrived last week. Do check out the USCIS/NVC sites.

Yes. And she's leaving next week. When we met last Monday, she was actually hesitant to let go of the CR1 application because of the AOS cost and additional processing time. I just asked her "Do you want to stay here and wait for your CR-1 Visa. Remember, you already waited two months for your visa due to delays caused by the infamous DV" or "Leave now and be with your husband and process your papers in the US in spite of the additional costs and processing time." Well like what I earlier said, she's already leaving. :)

She's actually leaving on the 29th and not next week. Lost track of time. :)

hey guys, what if my 129f and I130 will be approved at the same time...Can I just wait for the I!30 to get done and IGNORE the I129f which is for k3...CAN I IGNORE IT???

Assuming that's the case, I don't see any reason for you not to go for the CR1 route.
