hey everybody! i just realized today that my husband's k1 visa will expire nov.19. his aos is still processing and hasn't been touched since oct.2. we have to renew the k1, is that correct? is this done in person at a local uscis office?

thanks for your help!

May 19, 2008--move to the US

June 6, 2008--marriage

July 12, 2008--filed I-485 and I-765

July 14, 2008--NOA for both

October 3, 2008--work permit received

As long as marriage was within the 90 days of the I-94, you are fine.

NOTE: the expiration date on the K-1 visa is the date that entry to the USA has to be by, it has NOTHING to do with AOS. The K-1 is VOIDED the moment is is used to enter the USA.
