To get to SCOTUS, there has to be appeals. If it's overturned in the local courts, it will be appealed to the federal courts. If it's upheld, it will be appealed to the federal courts. This is going to continue happening until SCOTUS hears it, as it directly addresses an issue entirely relevant to the 14th Amendment. Keeping in mind these states ratified it, it means they must uphold it. FFCC is irrelevant in this case.

My dear SRVT - I'm trying to have a serious conversation with you. Why do you treat me like an idiot? You know I understand how the court system works.

This is going to continue happening until SCOTUS hears it, as it directly addresses an issue entirely relevant to the 14th Amendment. Keeping in mind these states ratified it, it means they must uphold it. FFCC is irrelevant in this case.
So many flaws here.

First - SCOTUS does not have to hear the case at all. If it goes through the courts, gets to a federal appeals court, and the prop 8 opponents lose, they can appeal to SCOTUS. However, SCOTUS does not have to hear the case! They decline to hear many, many cases. In fact, they decline to hear more cases than they actually hear. It's only a very small number of case appealed to SCOTUS that actually result in a hearing.

Second - even if SCOTUS does agree to hear the case, it does not mean it will actually uphold the constitution. Sure, that's what it is SUPPOSED to do - but there is ample evidence that SCOTUS will ignore the plain wording of the constitution, or otherwise find some way to fail to uphold it in some way. This is especially true with respect to the 14th Amendment (think Slaughter-House cases). Sure - FFCC, DP, and EPC are all on-point - however, at the end of the day, SCOTUS is free to ignore the constitution - just like POTUS and congress.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Does Cali always have this many propositions? My state (MI) had two:

Proposition 1 - Legalization of medical marijuana (PASSED)

Proposition 2 - Stem cell research (PASSED)

Can't believe there are so many people that are threatened by gay marriage, in this day and age... :blink:

I don't think there are, not honestly. I think they believed the negative ads which is a shame. Teaching gay marriage in school and all that malarky. I guess more energy will have to be wasted on this.

I had a conversation with my Republican MIL and a family friend about this the other day. I have to confess I still don't understand their objection to it - other than that they disagree with gay rights parades and the gayness somehow being flaunted in their faces.

What I did get from it is that while they are not opposed to people's sexual practices behind closed doors they aren't up for gays receiving rights pertaining to married couples or for the use of the word marriage being applied in regard to those relationships.

That's just sad for Prop 8. :(

It is sad - I'm just not sure I understand why this is an issue that requires a democratic referendum. Can we not call out prejudice and discrimination without resorting to a popular vote to validate it?
