TN and CR1

I just got married a week and a half ago down here in Georgia. I am from Canada and my wife from here. I will be returning soon to Canada, but my company is looking into sending me back down here to telework from Georgia on a TN visa for a year so that I can be with her. My question is, once I get here and started working on a TN visa, then would I be able to apply for the CR1 visa by filing the I130 paperwork?

Not much I can offer you but I'm Canadian and will be moving to (and have lived in) Georgia. Where are you located?

What TN visa classification are you applying for? I think you can adjust status but you want to make sure you follow the appropriate ways as to not mess with your working.

Once you are in US you can apply for Adjustment of status. It takes 3 to 6 months. I know that because someone in my office did the same in Nov. 2007 and she had her interview in the last weeek of March 2008.

My guess is that you won't get it once they learn you're married to a USC. You'll likely have to go for a CR1 or a K-3. Go CR1 so you can work.

Honestly, if it were as easy as getting a TN, most of us would have arranged that. My husband's work is transfering him to the US as well.

Just be careful as the TN visa is not a dual intent visa.... You might find the TN visa a challenge to get based on your current situation, but good luck to you...
