Exactly when (date) can apply for citizenship?

Hi, all...

I've looked everywhere I can think of (on these boards, on the govt. site, etc.) to try to find the answer to this question, but no luck. Maybe it's out there and I just somehow missed it. But hoping someone here knows the answer...

My husband is wanting to apply for citizenship. He's a LPR, I'm a citizen by birth. We've been married 3 years this past Sept., and he will have had his green card for 3 years this coming March (2009) and is currently still waiting for the lifting of conditions on that.

I know that because of our marriage, he can apply after 3 years since his green card (rather than 5 years if not married to a citizen). What I'm going crazy trying to find out is exactly when can we send in the citizenship application? Do we have to wait until the date on his green card (March 9)? Can we send it in earlier? If so, how much earlier without some sort of penalty/problem? (I know how the govt. doesn't like when you do something too early :angry: )

If you know the answer, along with sharing it with me, could you also please give me a source for the answer, which I can show my husband (who always likes to see the "official" information).

Lifting of Conditions Timeline.......

20 Mar 06 Received 2-year green card in the mail!!!

22 Feb 08 Mailed I-751 (Lifting of Conditions) to Nebraska Center address

25 Feb 08 Issued I-797 NOA for receipt of above

11 Mar 08 Issued I-797 NOA for Biometrics

28 Mar 08 Had new biometrics/fingerprints done at SLC application support center

21 Jul 08 Issued Notice that petition was approved and sent card--but we never received the notice or card

02 Jan 09 Checked online status for petition and learned about 7/21/08 approval...immediately called customer service, who sent a report about it to the CA service center (where it had been transferred to from NE)

03 Jan 09 Received email from CA service center saying card sent 7/21/08 was returned by the P.O. and they would resend the card immediately

13 Jan 09 Finally...10-year card successfully arrived in the mail!!!

i think you can send in your application for citizenship by december 09 this year. if this is wrong, don't worry, someone else will come along and correct me :P best wishes!

The USCIS provides a "Guide to Naturalization", it will answer most every question you have..

He can apply up to 90 days prior to eligibility...

Read the Guide to Naturalization. There is a flowchart somewhere near the end that your husband can follow to determine his eligibility.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Gather the date he received his green card is March 9, 2006, soonest he can apply then would be December 10, 2008, that is 90 days before his 3rd anniversary. Could wait until the 11th to be sure. Or even the 13th, on a Saturday, so you can check and double check your forms and evidence.

As I understand, you can apply the removal of condition 90days before the 2nd anniversary of your GC or 90days before the expiration and for Citizenship is 90days before the 3rd year anniv. I guess if you submit earlier the USCIS won't mind it or they will just process it and let you know their actions.. If you're not convince with my thoughts better call the 1-800numbers of USCIS.. goodluck on your application.

Ha, with marriage citizenship, conditional green card and all that jazz, if you can figure out what day to send in your I-751 as soon as possible, just add a year to that date for sending in your N-400.

You gotta send in that I-751, N-400 can wait a couple of days, after the election, not really much else going on if you want to vote. Then you have all that post oath stuff to do.
