There is no expedited military service, it does not matter if you're deploying, and the NOA2 will not be fast. All of that is just an urban legend. I'm still waiting for NOA2 just like all of the other August filers.

I'm in the U.S. military forward deployed to the Middle East currently in the K-1 process. USCIS has my deployment letter and they really don't care. The only reason they even need to know is because i'll likely be exempt from certain requirements (like showing up to the embassy appointment.) If you're deployed there is no reason to expedite anyways because you can't get married when you're in the sandbox. Just wait like everyone else.

My case is being handled by a fairly decent immigration attorney who corroborated this information.

13AUG08 - NOA1

18AUG08 - Touched

10DEC08 - NOA2

19DEC08 - Confirmed package left NVC, en route to Bogota

They probably factor in how long you will be there, or how long you've been there etc. There is probably no point in granting an expedite if you have just deployed and will be gone for a year or longer as the visa may be approved long before you get back.

You got lucky, don't expect others to get the same. Expediting a deployed member's petition makes absolutely no sense other than trying to solicit a favor because of one's position.

Ummm I think it's like anything else in this process... a ####### shoot!

I too have seen almost every known request for a military deployment expedite here on VJ be approved.

I'm curious if you were actually denied after trying of if you are just going by what your lawyer told you.

I too have seen almost every known request for a military deployment expedite here on VJ be approved.

I'm curious if you were actually denied after trying of if you are just going by what your lawyer told you.

Forgive me for sounding harsh, but as an honorable member of military law enforcement I must state my opinion that asking for a military expedite is an abuse of authority. A lot of government agencies will grant almost any request written on Command letterhead but that does not mean it's morally correct.

I stand by my original assessment that there is no legit reason to expedite for a deployment unless the entire process is aimed at completion prior to the commencement of the deployment so your new dependents can claim benefits. Otherwise you're just cutting in line.

USCIS knows of my deployment status and again there is no expedite. I did not ask for one and do not want one if it means cheating the system.

we only did what we had a legitimated right to do. If you do not think that is appropriate for your situation, that depends on each individual's personal decisions. If you feel like asking for expedite for a case where a military is involved, that is your personal judgement that does not give you the right to offend what we have done or to judge if our action is either moral or not. I respect your opinion. However, it is just that and others are entitled to their opinions as well.

Your comments in this thread suggest that others do not deserve and/or will not be approved if they request an expedite. I am assuming this perception is based off of your lawyers comments to you. What we're saying is that this is one of the VERY few reasons we do see an expedite and that it can and does happen. If you choose not to request it then that is your choice and nobody should try to convince you otherwise but the same holds true for you.

I happen to feel that if the USC fiance is facing deployment and the couple is forced to spend that much more time apart in the near future then that couple has every right to request an expedite. And I, for one, hope they get it. ;)

For the benefit of others, I should probably also add that the expedite needs to be requested through the USCIS ...and then again at each stage of the process thereafter. It will not just happen because they have a deployment letter on file with your petition.

What you've written in bold above is what I understand to be the one and only legitimate reason for a military related expedite. If the foreign fiance or spouse has no chance of arriving in the US before the deployment occurs, there's no legitimate benefit. I guess I can think of one exception (maybe there are more) such as a pregnant spouse, who would derive benefits upon arrival even if the service member was already deployed. A K1 applicant would not have such a benefit, since they would need to marry in the USA first.

As I understand the deployment related expedite process, it is intended to benefit the "family" of the service member. When there is no family to benefit, there is no reason to expedite. A fiance who can become "family" prior to deployment is "family" in this scenario. One who can't possibly arrive until after deployment is not.
