Is a K1 suppose to be quicker than a K3? Or are they about the same time?

theoretically even if the times are identical, since you can get a jump on the filing process because a petition for K-1 can be submitted now instead of waiting for a marriage to occur... you eliminate that delay right away

YMMV

K-1 is a bit quicker because there is NO filing or an I-130 before filing the I-129F.

K-3 also requires you to marry first before filing the petition.

Lastly forget the K-3 and consider the CR-1, you will be happier for it.

For most countries CR-1 takes about the same time to get as K-3, compare timelines.

CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

One note, K-1 requires that you have physically met the person within the past 2 years, so if you have not done that yet, you cannot file the I-129F

From the research I did and the brief lawyer consult before I filed I was told that the K1 is quicker on average by a few months. But with the K3 your spouse is on the path to being a resident right away after they get the visa, whereas with the K1 you have to begin another, long expensive process after the marriage in the US to keep them there with you.

Not true, K-3 has the same expensive process to get a green-card as the K-1.

You are talking about CR-1, that visa gets a green-card upon entry to the USA.

Nooooooooooooooooooo.... in that regard the K-1 & K-3 are no different... both require Adjustment of Status application to Permanent resident... the absence of which means no Green Card for either

YMMV

I couldn't have said it better myself.

K3s are basically "dinosaurs" at this time.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

:) You like that, I have been refining my stock answer to K-3 over time. Cut and Paste.
