Applied for a Visa for my Wife and Kid Need Help

Hi All,

I applied for my Wife and Kid who is 1 1/2 years old with an attorney in Chicago. My wife and I got married in Jan 2006 and I filed the petition in Aug 08 for her and my kid. I delayed the visa filing due to my mothers sudden passing away on her visit to Hyderabad, India. I wanted to know what is the approximate time it would take for me to fly my wife and kid to the US as I am tired of being here and am really anxious to get back as soon as possible. I am a US Citizen by birth and have provided all relative documentation regarding my wife and son that corresponds our relationship. My case is at the CSC was recieved on Aug, 29th, 2008 and was touched on Sept 4th & 19th and nothing there after just worried if becuase I filed late would there be any problems.

If you are a US Citizen your kid may be entitled to citizenship too. The spouse visa process generally takes between six months and a year.

Thank you very much for the info sir. I was told that I could get automatic citizenship for my son. But we goofed up and made an Indian passport for him as I didnt know. I have also sent the same to USCIS for processing would it delay the process for any reason??

Yes I do believe that US and India do have the Dual National accord signed. Last time I went to US to extend my visa for India I had an option but couldnt wait for 3 months.

If a child has a claim or a potential claim to US citizenship they will NOT be issued a visa until that is resolved... You might as well start down that road right now.... either by getting the child birth reported and a US passport or get his citizenship status denied....

You still can get US passport for you son.

Contact US embassy in New Delhi.

Based on the time line it will take anywhere between 10 months t0 14 months.
