K1 Application -- What about children?

I have my K1 paperwork almost ready to be filed, but there has been a bunch of questions about my fiance's child. She has divorce paperwork that says she has 100% custody, but they fear that there will be a problem, or that they need her ex to file something special for her child to come over.

Has anyone done a K1 with a spouse with children? Is there anything special that I must put in the first set of papers I file for her child? Someone told me I just have to file a K2 at a later date and the Service Center will let me know when.

What is needed to get the child out of the country will vary with the country. I would email the Consulate telling them what you do have to prove sole custody and ask them if it will be sufficient.

At the initial filing, you simply list the child's name and information asked for. Then, they'll be given the opportunity to apply for a K2 visa concurrently with their parent's K1.

Separate AOS filings are required after your marriage in the US.

List the child on the I-129F, and EX may need to provide a letter for visa interview stating that they have no problem with the child leaving the country.

UPDATE: I just received the translated divorce documents and it says that she was given guardianship of the child however the courts granted specific dates for visitation which my understanding is that he never visits her. Does anyone know what is going to be proper in Turkey? I am checking with a friend at the consulate to see what they require.
