Still no EAD?

Oh my my. This is ridiculous. Yep, probably they will do service request after 90days. I am also thinking about contacting a local congressman I tried to get help for my K1 visa.

His office acts very quickly.

Well I filled on June 5 and still nothing even after service request. You may just end up getting a green card and no ead.

That is what happened to us.

Well I called to USCIS and they said they will put in some kind of email and then I should wait 5 days to get a response from them and they didn't respond. So tomorrow I have an info pass appointment and I will tell you how it goes.

when you say 90 days after filing does it still count if you received an RFE? Or because of the RFE they get more time until we can complain to them?

Hi everyone. I have applied for AOS on the 19th of July and still no update. I finished my biometric.

Since then, I have no update or no touch.

I start seeing a lot of people who filed after me are approved. Even August filers.

Did everyone get e-mail?

I signed up for e-mail, but I do not get any updates.

We applied on June 12th. We got an email for NOA1 with the Biometrics appt, but have received no updates since then other than an RFE in the mail that didn't show up on the website...they were asking us to send evidence of a pending AOS app, which was in the same packet! Even the processing times website is Bogus. I called USCIS because it's past the processing time and the lady I talked to said that those numbers aren't accurate. So, I think the lucky people get emails and their processing times correspond to predicted ones...I don't think we're so lucky though

If I were you, I would schedule an Infopass appointment for the 19th of October as soon as possible. They only let you schedule appointments about 2 weeks out it looks like...and the 19th will be 90days for you, at which point you're eligible for an interim EAD. They were very nice at our Infopass appointment...but basically told us to wait 2 more weeks then come back.

...let's keep waiting together...

UPDATE: Infopass is worth your time. We did an infopass two weeks ago. They did a "service call" and said to wait another 2 weeks. We made another INFOPASS appointment immediately after leaving the first one. We scheduled this one for 2 weeks out, since that's how long they asked us to wait. Tomorrow morning we were planning to attend that INFOPASS appointment, but I just checked the USCIS website and they have approved our AP and EAD! EXACTLY 2 weeks after the appointment...maybe they knew we were coming back and didn't want to be bothered again! Schedule those appointments on day 90!

From what I understand from my 3 RFE's they have 60 days from the date that they received your letter (they will send an email to let you know your case processing has resumed) to give you an answer. So technically no it's 90, but it is 60...

Processing of your entire packet is stopped once an RFE is sent out.

Funny you wrote that because I called USCIC again 2days ago and they told me the same! The man I talked to saw that I put service request in about 8days earlier. He decided that he will "write" some kind of e-mail saying that I`ve been waiting for my EAD over 120 days and it needs to be taking care of asap (he did it with me on the phone). He told me to wait 30-45 days and if nothing changes-to call again (another 30 days!!! ). Awesome, gotta "love" USCIS!

That`s my update -which is no update at all actually!

Anyway, hope your case (and others who are still waiting ) goes much better than mine!

At the info pass they didn't notice anything about the service request that I had put in. So they called the National Benefits Center for me. The officer was amazing he made up a story for me as to why I should get an ead asap. He kept winking at me while he told a bunch of garbage to the NBC person on the phone. They said they would get my ead looked at today and that it would be done in 2-3 weeks. So no real update but hopefully I will have something to tell you in 2-3 weeks. However, at least seeing the person face to face made it easier to explain than just talking on the phone.

One other thing he told me was that since I filed my 485 concurrently and that asked for RFEs that they may have forgotten about my ead because they were focusing on the other one.

Kstar, of course "i have THIS and many other kinds of body language gestures" in Poland ... that`s why I said I WOULDN`T mind it at all! All I meant was that talking to a friendly IO , who would really try and help with pending EAD (by doing more than just say famous "you have to wait" line ) is quite unusual!! That`s all.

Well... I made an infopass for my husband and went today in S.F. I get there and the 1st woman asks why I am here and I told her for his EAD...right away she said we can't do anything here for you... in the same breath she says we can make a service call...

the second window, she wasn't nice at all and asked for papers and then she asks "why do u need EAD for?"... well, hello work... he needs a job... We told her and she said all I can do put a call... she was on the phone for about 6-8 min. she talked about everything and anything except asking the other person what's going on with EAD... anyhow after 6-8 min. chatting she came back and said they're reviewing it... you should get it in 2 weeks... I asked her what's there to review... she said "I told you they have to review it and we can't do anything" I was so close to ask for her supervisor she had a big attitude...and I don't think she asked the other person anything about his EAD... she just told us what she would tell anyone in our situation...anyhow, I asked her what if it doesn't come in 2 weeks? she said to make another appointment... I be making an appointment today for the next 2 weeks just in case...

Try to contact USCIS one more time. It is better to do so. Let me tell you that. I called up probably about 6-7 times since last week. Yesterday, I call up USCIS twice. Finally, one gentleman, he was so nice and understood my situation and put service request for me. Other reps are useless. Every single individual said different things. Like oh we are now processing April 16th applications. Oh we are now processing June 2nd applications. Oh usually EAD takes more than 90 days.

Ha? they do not even know what they are talking about.

you should write e-mail to them and let them know that you called up USCIS and even did infopass.

I had to cancel my infopass because this gentleman did service request for me on the phone.

Thank you Kittykat... I just checked status on-line and it stated his EAD card was ordered today 10/22/08... hopefully it be in the mail soon.
