Hi ,

Dnt know this is the right forum to post or not but this is really urgent for me to know .......... pushbrk helped us reallyregarding some points.

My husband who is from India is adjusting through me here in USA. He was on B1/B2 visa and we got married .......now his visa is expired and we are getting ready to file for AOS . I am writing for a small clarification regarding a income deficiency and your kind & expert openion on that. I make 16,500 and a bit above from my disability income.I have a business but its runs in a loss. Though this year I have a renter where from I am earning $7200 extra.

i) Thus in the current income of I-864 I am writing , $23,700. ( $16,500 + $7,200)...is that ok to write ?

ii) As you know all prices have gone high and my vectran(gas & heating bills) have doubled ..... which with my present income is becoming impossible for me to bear.Now I approached an organisation named Community Action Partnership ( http://www.cap-dayton.org/ ) , who helps paying your electricity/ gas and they wanted to know about my husband. I told them that he was here legally and we have married and now we are to apply for AOS. They are not ready to count him in as he does`nt have a SSN.They told me to come, & meet them along with him and his passport.

Now I have two queries :

a) Will taking him there and showing them his expired visa will cause any legal harm ??

b)If I take help of this organisation in paying my gas & heating, wd USCIS wd come to know anyway and push me under poverty level ?

These questions may be absolutely silly but I entirely depend on your expertise & advice & on this forum for last help ....pls help me ....

May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card
Removing Condition
3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC
5/16/11- NOA 1 received
5/27/11 - Biometrics letter received.Scheduled on 06/06/11. Case Online
6/6/11 - Biometrics done

Line 22 of Form 1040 is what you need to be cognizant of... If your total rental income is $7200, but you deduct expenses from it on Schedule E, then you might be hard pressed to claim the entire amount. If your Schedule C ran at a loss, then it will have a negative effect on Line 22 as well.

a) well, if his visa is expired and you haven't applied for AOS doesn't that make him an illegal alien? Had to re-read your post, he officially is illegal with visa expiration but you are married which sortof makes it legal but there are gray areas...good luck here!

b)Nope, in the fine details it is the immigrant that can not become a ward of the state, says nothing about you... but if they somehow see this it will not help the AOS I'm sure.

He's not illegal. His status is "pending adjustment of status". "Pay" made a good point. If your renter lives in your home and there are no associated expenses, then the whole amount of rent paid could be considered as income. If it's a rental property, only the profit is income. Please clarify whether the $7200 is "revenue" or "income" per any future tax return.

Facts are cheap...knowing how to use them is precious...

Thanks Pushbrk.Yes there is no expenses actually.My renter lives in a part of my home ...so aparently ther`s no expense. Its a whole Profit for me.
