Hi,

My name is Kateryna I. and I am a citizen of Ukraine and a holder of the US Permanent Residency Card (Green Card). My Green Card has expired on the 06/19/2006 and following the US Department of State’s advice, I am contacting you to seek your advice on how to proceed with the renewal.

This year I have turned 21. I received a Bachelors Degree in International Economics under Kiev National University of Economics. I would like to continue my residence in the United States, specifically pursuer Master’s Degree and obtain further employment in the country.

As a background: in year 1994-1996 my father was invited to work for Medical School under University of Miami. As a consequence our family moved to the United States. I attended Marten Luther King Elementary School in Boston and Kenwood Elementary School in Miami from 2nd to 4th grade. In year 1996 our whole family received Alien Registration Receipt Cards. My parents were very homesick and our family relocated back to Ukraine the same year. The decision of coming back to Ukraine was originally not mine, as I was only a child.

I have the following questions:

a) Can I proceed with the GC renewal? And can I apply from Ukraine?

B) Can I enter the United States with an expired Green Card in order to renew it from there?

c) Do I have to apply for an F-1 visa while my Green Card process is in progress if I would like to begin my studies in the spring semester?

d) I understand that I may be denied an entry to the US under the current Green Card, but can I travel with the expired CG and a document saying that it is being proceed?

I would greatly appreciate any suggestions you may have on how to proceed with my Green card renewal.

You have been out of the U.S. for several years. Your permanent residence was abandoned. You cannot simply renew the GC.

To answer your specific questions:

a ) No, No

b ) No

c ) Application for F1 visa is a separate concern. You may or may not be approved, but you will not have a GC in progress

d ) You cannot enter the U.S. with the expired GC.

GC Status is abandoned after 6 months residing elsewhere from the US. Your GC expired 2 years ago. Only possibility is F-1 is you apply as a Ukranian, but forget about the GC. As a matter of fact you should hand it back to the US authorities (Embassy is good enought).

Only way for you to get a GC is either be married or about to get married with a US Citizen.

Don't let the choices chose you, chose the choices that you want.

Unfortunately, everyone is right. You would no longer be considered a permanent resident as you left the US 10 years ago. Your parents residency status got abandoned and consequently yours as well being a minor child.
