Filing for AOS

Hi

My K1 in my passport has an expiration date of 22 Sept 06 and my I-94 has 28 June 2006.

I was under the impression I had til 28th June to file for AOS.. or is it the expiration of my K1?

I'll be filing in the next few weeks, am just curious.

28 June 2006 is the expiration date for you I-94 not the deadline to file for AOS. It is always best to file for AOS as soon as you can.

Technically you have until your I94 expires to apply for AOS, however there are many who apply after.

It's best to apply before the I94 expires or technically you'll be "out of status". Nothing really happens to anyone that I have heard of if you do in fact apply for AOS after your I94 has expired. But in these crazy times of Immigration I say try to follow the guidelines if you can.

Hi Helen,

as has been mentioned, the 90 days in which you should get married and ideally file your AOS application is indicated by the I-94 stabled in your passport. The date on your K-1 visa is the end date by which you had to use the K-1 to enter the US, so you needed to enter the US prior to September 22. The 90 days on the I-94 starts from the date of entry when you used your K-1. Good luck with your filing:-).

Like Kathryn said - your K1 expired the date you entered USA - its one use only. And the I94 is now the document you need to follow up with. And as others have said a few weeks past that won't make a difference as long as you get married within the 90 days. Good Luck
