Timeline

Lucero applied for a SS card 2 weeks after she got here. We have been to the office so many times it is unreal. She got the number but she never got the card.

We went about a month ago now that we have the EAD to try again. We showed the EAD that has the name Lucero wants to use ( Lucero/ maiden name/ my last name ). It seemed pretty straight forward. We took her passport, our certified marriage liscense, and the EAD card. We filled the papers with the exact name from the EAD card.

Today Lucero got a letter that she needed to come back to the office about the name. The lady in the office told her that the EAD card means nothing to them. They want Lucero to go to the courthouse and do a legal name change for $250 or they wont give her the card. Luckily I was at work, or I would have lost my cool completely.

Marriage document or marriage record to be acceptable as an identity document it must show, in addition to the new name, the person’s age or DOB or parents’ names

a. Bride Takes Groom’s Last Name

In all 50 U.S. States (this means the 50 States, Washington, D.C., Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa) the bride may take her husband's last name (surname or family name) as her new last name. (EXAMPLE: Jane Doe married John Jones and she may change her name to Jane Jones.)

Interim Guidance: If the bride wants to take her husband’s last name, accept the marriage document as a legal name change for the bride if the new name can be derived from the marriage document; even if the marriage document only shows each partner’s first names, the bride’s prior surname and husband’s surname.

C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

In cases where an alien applies for a replacement SSN card and submits an immigration document showing a name that is different from the name on the prior Numident record, accept the immigration document as evidence of the legal name. In these cases, the prior SSN card may have been issued in a name that was not the NH’s legal name.

Remember that immigration status must always be verified before an SSN card can be issued.

6. Change of Middle Name to Maiden Name on SSN Card

It is a common occurrence in the U.S. for a woman to take her maiden name as the middle name after marriage. Because a legal name generally consists of a first or given name and a surname or family name, whether the identity document submitted shows the middle name is included, omitted or incorrect does not matter.

MD Young's post clearly shows that this is acceptable. It is the name that USCIS printed on the EAD card ( exactly letter for letter ). For months now the SS office has been telling us that all we needed was the EAD card and we were home free. Now they say it means nothing.

I thought we had this solved a month ago when we frist got the EAD. They told us we would have the card in a couple of weeks. The letter we got did not come from the local office. I can only guess that they are having problems clearing the name through USCIS.

If they didn't accept the application it might be time to try another SSA office. Did you ask for the office manager? If they took the application you are stuck with dealing with that office.

If they did take the application you don't send the G-845 for a middle name.

This is not a data discrepancy. Do not request DHS to verify the middle name or initial when the SAVE query response does not show the middle name (or initial) that is shown on the immigration document submitted. When the DHS database has a middle name or middle initial, DHS provides that information to SSA. However, the middle name or middle initial data is not displayed on the SSA SAVE query response screen.

Lucero went to the DMV and got a liscense today. When they asked her for a social security card she told them she didn't have one, which is true. They never gave her a card. She left with the DL. When I got home there was the NOA with a 13 July interview in Jacksonville. This was a really great day for us.

The DL is in the name that the USCIS used. The nOA also had her full legal name. When we get the actual drivers license I am going to the SS office and find out why they don't seem to like her name.

I am really sorry to hear it...I am using my maiden name for my new middle name, too (since I did not have middle name before marriage).

When I was talking to lawyer about this issue, she said I do not need to go to court and just use new name to fill in the green card application forms.

Joe, I'm so happy that Lucero got her license without any hassle. I am wishing you guys luck with dealing with the SSA (again). Hope they'll sort things out for you. :yes:

A really great person jumped in the middle of this whole thing today in response to some E mails I had sent to SSA. I don't really know who this person was but he seemed to wield a lot of power over the local office. He did a 3 way call to the local office and spanked the suprevisor's ### on the phone. It turns out that the save system works if you simply go by the guidelines from the links that MD Young has provided for all of us.

They found Lucero on the SAVE system and promised we would have a card in a week or 2. I don't think the lady would have lied to me with this guy listening in on every word.
