I have just finished gathering all the information to send to my fiance in order that he can submit his I-129F but I am now really concerned regarding the new law and its impact on new applications. If we send in the I-129F now are we likely to receive an immediate RFE as I understand he will be required to fill out a new form authorising a criminal background check (but at least we would be in the "system")? Or would it be better to wait until the new form is made available before we send anything off?

To make things worse our service centre will be Vermont. When we originally looked into this that was good news, we had hoped to be together in a few months, now it looks like we'll be lucky to be spending Christmas together. :(

We both knew this wasn't going to be an easy process but i feel like we have hit a major hurdle before we have even started. Any advice or recommendations would be appreciated.

There is nothing like today to get things started........why wait. As for VSC, they will kick a$$ again soon. The amount of petitions that were recalled is only a drop in the ocean compared to the numerous amount of other petition types that are processed.

Well if you look at the processing times of the other service centers Vermont is still ahead with process dates of March 6th (even though at a standstill). At worst case Vermont will be even with process dates of other centers because none of the SV's will be issuing NOA2's, with a receipt date of Marth 6th or greater until a process is in place. I would send the petition in now as you will have a place in the queue. You can wait but it's FIFO.

No one really knows at this stage what they are going to ask for, if they even ask for it. If you send the form in now it would probably benefit you, because like I said they may or may not request anything from us. The worse that could happen if you send it now would be getting a RFE for the new requirements (which they would do with everyone’s case anyways). If you do send it now and they don’t need anything from us then you would at least be ahead as far as your processing time goes.
