A bit confused? I30 Approved today, but what about 129?

Timeline

Looking at your timeline in the signature, it seems as if you sent in the I129F without waiting for the NOA for the I130. Is that right? If you did it that way then that was not the right way to go about it. I'm guessing your I129F was rejected.

You're supposed to first file the I130, wait for its NOA1, then mail the I129f where the I130 is pending. Congratulations for the approval anyways. You should go with the CR1 route now.

We applied for the K3! The I30 was approved today, but the 129 is still pending?

Has this happened to anyone?

What does this mean?

Well we hired a lawyer. So whatever the Lawyer did. I know the lawyer put in the 129 first, then 2-3 days shortly after the 130.

Also, the instruction of filing an I129F from USCIS say: "U.S. citizens petitioning for K-3visas for their alien spouses must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse listed on this form." This means attaching a copy of the NOA1 you receive for the I130 with the I129F form.

And from the department of state website:

Filing - Two Petitions are Required

You must first file an immigrant Petition for Alien Relative, form I-130 for your spouse with the USCIS Office that serves the area where you live. The USCIS will send you a Notice of Action (Form I-797) receipt notice. This notice tells you that the USCIS has received the petition.

You next file Petition for Alien Fiancé(e), form I-129F for your spouse and children. Send the I-129F petition, supporting documents and a copy of the Form I-797 receipt notice to this Department of Homeland Security USCIS Address on their web site.

So I suppose your lawyer made a mistake / didn't know the process. Good luck on firing him / her.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

What i know is that even if the 129 is approved, the embassy will most probably disregard that in favor of the 130.

12-09-08 - INTERVIEW @ 6:30AM...God be with us! --- APPROVED!!!
