I think it's a great idea to see each other again. If you haven't met in person in the last 2 years (you mentioned it was 3 years), you certainly don't want to be petitioning anyone to come here to marry. You mentioned things had changed for you in the last few years, and you had taken some steps backward. People change. It's hard enough one party changing with their partner by their side, let alone changes you BOTH might have made while you've been apart.

If she's that anxious about not waiting, or wanting to side-step the issue, you might want to spend some time on the relationship before applying for a K-1.

The US Citizen files a "petition" not an application. When the petition is approved, the foreign fiance is given the priviledge of making a visa "application".

No, your fiancee is mistaken. USCIS is very adamant about that 'having met within the last 2 years' requirement. Some people have tried for hardship waivers due to health or finances, but I don't recall of any being allowed even for serious health issues. When you submit the I-129f you need to provide evidence (passport stamps, air travel proof, etc.) that you have physically been together within the two years immediately prior to filing. You will need to find some way for the two of you to get together again before you file. If you file without meeting this condition, your application will be denied and you will have just wasted your money.

jst want to ask?u sure that the application will be deny if the petitioner and the beneficiary havent seen each other for the last 2 years???I have the same case....i have seen my fiancee year 2005august,we do talk everyday...are those evidence not enough to prove that we have a strong relationship??

Proving a strong relationship is done at the visa interview and again when adjusting status.

At petition filing, you prove you've been together in person during the past two years. If you haven't, the petition will be denied with no refund on the filing fee.

Hi, I'm new here, and I have a very serious problem. I met a girl on the internet, fell in love with her, and visited her in the Philippines three years ago now. I've gone through a rough stretch in my life for those past three years. I've always been planning to bring her over here so we can get married, but have read that it is required that you must have visited her in the past TWO years. Things are getting edgy now, and she's said that there are people that have somehow bypassed this regulation. Is this correct? Or something that she's misunderstood? And if so, how? Any help would be very greatly appreciated. Thanks

If I was you I would go as soon as possible, even if she has to work. This type of relationship is hard enough , but not seeing each other makes it harder.. I know she said for you to wait , but hey , its your money and if you want to see you , I would just do it .. I havent seen my fiancee in 4 months , I am going back in 2 weeks . And I will not wait 4 months again ,,,3 at the most. We file our petition as soon as I get back ( Oct 6 ), And I will be there again for x-mas and then it should be about time for interview and I am going back for that also..

I will do anything needed to see her as often as possible .. Plus it will give you some peace of mind and that is priceless...

Thank you Charles, I was hoping to visit her again next month, but she's run out of vacation time and doesn't want me spending money when she won't be able to take advantage of our time together... it's starting to be a very complicated situation here.

You've already waited 3 years. Just go over there are hang out on weekends and after work. There's no requirement that you have to spent every waking hour together. Have her call in sick a couple of days if possible.

If her vacation time is fairly soon just wait a little longer.

I agree with ALC (a phrase I never thought I'd say on VJ :) ) Even if you can't spend all your time together, it might be nice to see how you get along when in a situation where you have to work around tight schedules as well.

If you have not met within the last two years, your petition will probably be denied. Talking everyday doesn't fulfill the requirement of having met within the past two years. I'm sorry to say Pam, but you will most likely 100% be denied. :(
