Got a quick question...Got my fiance here on a K!, got married and I am taking his name...still not changed any of my documents (driver's license, ect...). Now filling up our documents for AOS and EDA...can I use my new last name or should I use what I did for the K1? I was previously married and up until now I have been using my ex-husband's last name...would I confuse the USCIS? not sure what is the best road to get it done.

09/15/2009 - Application mailed to Texas Lockbox

09/17/2009 - Delivered to the Lockbox

09/21/2009 - Check cashed

09/24/2009 - NOA dated 9/18/09

09/26/2009 - RFE mailed out dated 9/25 (biometrics notice)

10/14/2009 - Biometrics completed

01/01/2010 - finally an update - awaiting interview letter

02/08/2010 - interview (Garden City, NY) -- PASSED

03/03/2010 - Oath Ceremony in Brooklyn

03/13/2010 - U.S. Passport in hand

I would suggest use the new name and include a copy of the marriage certificate to show the connection. (Well you have to include a copy of the marriage license anyway so its already submitted.) Good Luck

I'm pretty sure you can use your new married name for filing with the AOS forms.. Your marriage is the purpose of these forms, so i'm sure USCIS can figure out that you took your husband's name.. :-) Good luck!

Yes, now is the time to give USCIS your new name... just use it on your paperwork and your EAD and greencard will show up with the proper name on them :)
