File K1 visa while divorce?

Hi everyone, I am USC and engaged to Indonesian cz last July. We've been in a relationship for about 1 1/2 years. I visited him several times during those 1 1/2 years when I was separated with my ex husband. I filed for divorced last March'08 and i will get the divorce decree in Sept'08. Can I file for K1 visa after my divorce? Will this raise any red flag if I do this? What would be the best thing for us to do if this raise any red flag to the INS? In my divorce paper, it stated "cannot re-marry or have a domestic relationship after decree" is this engagement considered domestic relationship (i apologized for asking this stupid question) Is it better to use the attorney or visa services as u see in the advertisement in the internet? Please help!!! I dont know what to do.... I am really confused.... I was reading this forum and it seemed that everyone is really nice and help each other... any inputs really greatly appreciate it...

You have to file after because you certainly cannot file before you are divorced....

Basicly one of the requesite to file for K1 Visa is that both the petitioner and the beneficiary are free to married. This means that once you have your final divorce decree in hand you can start to file for k1 visa. Just check if there is any remarriage waiting period after divorce decree in your state. You can check on this website www.totaldivorce.com/remarriage_waiting_period.asp

There are many people who date while their divorce is pending and that file for K1 Visa right after their divorce decree is issued...we are some of them!

It's funny Rocky had final orders last thursday and should have divorce decree in hand in a couple of weeks and we will file as soon as he get it... This was something that I was worried about too but I looked around this website a lot and I really found a lot of couples that had no problems about it. If you can show you have a genuine relationship it shouldn't be a issued at all. Anyways I don't think we will use an attorney because the fact that the divorce is so closed to the day that we will file it's not a real reason for a visa denial. For sure, they can make some double checks, but as I say I think that if everything is regoular there shouldn't be a lot of problems. I hope we'll both have good luck!!
