Hi :) I'm preparing the forms for the AOS package and I have some questions...hope you will help me.

AFFIDAVIT OF SUPPORT (I-864)

1) My husband has an early retirement (2005). His disability pension is above the 125% income requirement and tax free. What are we going to submit instead of the tax returns required?

2) He is paying child support but does not have custody; do we claim that child as a dependent?

MEDICAL EXAMINATION of Aliens Seeking Adjustment of Status (I-693a)

1) I completed my medical exam March, 2008 in the USA and the civil surgeon had given me a sealed envelop containing the I-693a. Is it still valid or do I have to ask him to fill out the new form I-693?

**We, originally listed my son as K2 but due to his schooling, he can't make it. Will it matter in the AOS?

These are all for now. I'm confident my fellow VJ'ers will extend their generous hands. God bless (F)

I'd go back to the civil surgeon and have him transfer the info on to a I-693 just to be safe.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thank you Charles for moving this post and thank you for the suggestion Haole. However, this link from the USCIS says that there's no need to do that...

"06/05/08. Previous editions will be accepted only for medical exams conducted before August 1, 2008. Medical exams conducted on or after August 1, 2008, require use of the 06/05/08 edition."

Any information regarding my questions will be gladly appreciated. And please help me pray that I will pass my NCLEX exam.

AOS

1) Does he receive 1099's?

2) Only if claimed as a dependant on the tax return

K-2 - If the child is not present in the USA then you will not claim him on the I-864 as a dependant... The effect will be to lower the 125% threshold.

B)

1) He received 1099-INT for 2007 ( minimal) from the bank. His pension is tax-free since he was injured on the job.

2) There is no need to file tax return from 2006.
