Congrats! My husband's interview will be on the same day.

The Embassy did not tell my husband to bring anything with him. He already DHl' the stuff with the interviewer did not collect it at the 1st interview.

Isn't it wierd how other embassy say the AP is complete submit your passport for visa, but our embassy schedules a second interview. Fustrating.

We have been on AP since August 12, 2008. I called the DOS this afternoon and found out AP is now complete and my husband will have his 2nd interview on December 8, 2008.

I have a question though. Is he supposed to bring all the evidence he brought with him to the first interview? I know he will need to get another police certificate because the other one expired in July.

They do not take the Visa fee if you did not get the VISA. Do you actualy pay for an interview or do you pay for the VISA? I know he did not pay the money and he will bring the fee again to this interview.

Do you have to pay for the second interview? How odd.

Got a question for you Missy. DOS told me yesterday that the embassy sent a packet to my husband's home through DHL last week. As of yet, he has not received it. They said in that packet he will have a paper that has his interview date on it to take to the embassy (because you cannot enter the embassy without proving you have an appointment) and also instructions on what to bring with him on that day. He never has gotten a call from the embassy to come back. We only found out because I called DOS last week. My question to you is did your husband receive a packet through DHL informing him of his interview date and what to bring? I remember you saying that he was going to the embassy to find out what he needed. I just wondered what happened. I know your husband is going for CR1 and mine is going for K3. I don't know if the embassy handles coming back from AP differently because of it being different visa types.

Thanks for answering my millions of questions, lol. I am sure you are getting quite weary of me asking so much, lol!

I have not asked him if he has gone to the embassy yet. I recomend your SO going on an informaiton day. they will give him his letter then. Similiar to when you never get packet 4 with the date of the interview. Usually they just go to the embassy and get the packet.

Indianheart - why is your case being returned to USCIS? Is the visa being denied? Under what terms? I am so sorry...this is all one big nightmare. :crying:

I guess the embassy believes when a man is divorced he should not have any communication with his ex even when they have children together (my husband loves his kids very much and spends as much time with them as he can). I guess spending 6 months in India with my husband over the last 3 years doesnt count for anything with the CO's. They didnt even ask for further evidence. When my husband had his interview they kept him till the end of the day, last to be interviewed and asked to return at which time they called me at 3 am and interviewed me too. They wanted to deny us from the beginning and looked for anything they could use to send it back.

I am not done fightning, this is not over by a long shot. I am meeting with an attorney next week. I should have used an attorney from the beginning.

So they are saying that you don't have bonafide relationship because he is still in communication with his ex wife whom he has children with? Wow. Just when you think it doesn't get much worse than AP, they throw more ####### at you. I am so sorry to hear that you are dealing with this. I hope that a lawyer can help and that you can somehow resolve this whole mess. :Hugs:

I'm so sorry to hear this has been tangled up in yet another nightmare. My prayers go out to you. There is a sticky in the MENA thread about 221(g) denials and the next steps to take. I know that one of the women there has had luck in having a denial for a CR1 overturned [martiniolive] in the last month, she ended up speaking with the Consule General for that specific embassy/consulate I believe - somehow got him a third interview and it was resolved. Also, a few of the women have attorneys' names who handle denials specifically....I want to say Khia or Kia?

Anyway, take a look over there.

I also know a couple of good expat sites for Americans living in India if you're interested. Not knowing what may happen, I've been researching the move too...
