After both petition approved (I-129F and I-130)

Timeline

As you guys know that my both petition got approved on same time and date (Aug. 03, 2008). Then they forwarded to NVC. then a Aug. 11, 2008 I got letter from NVC case number for I-129F, and nothing for I-130. So questions are:

Does that means they went with K3 visa?

What happened to my I-130 (CR1) form?

They said they will transfer my case to US embassy in India within a weak.

Can you guys tell me what do I need to get ready (paper works) when get Packet 3 and Packet 4? So, my wife can early.

are there any short cut?

From my you can see that I don't think we have choice to pick the route we want (k3 or cr1), It's up to them.

by they way, I will let you know what happens to my case and etc.

I don't have an answer for you, but I can't tell you what I'd pay to have had the opportunity to go the I-129F / K-3 route. For some unknown reason, VSC only approved my I-130, despite having approved my request to expedite the I-129F just days earlier. sigh....

02/15/2008 mailed I-129F

05/10/2008 apply for expedite on I-129F and it's accepted!

05/14/2008 NOA2 for I-130, I-129F is administratively closed. d'oh! Now he has to take a 20 hour bus ride to the embassy, instead of getting the visa at the embassy 2 km from where he lives :( We had been trying for the K-3. Now we try to figure out the CR-1 process

05/16/2008 went back to Rwanda with my mom and MoH for the church wedding

05/25/2008 church wedding!! I got spoiled rotten :)

05/26/2008 honeymooooooon

06/05/2008 contact embassy. They tell me to leave important papers with him. (bzzzt! wrong answer!)

06/07/2008 got back to the US, mailed AOS bill

06/08/2008 finally figure out CR-1 process (thanks, guys!) and realize that I need all of the important papers. double d'oh! He starts to collect things like his birth certificate.

06/10/2008 emailed DS-3023

07/16/2008 he finally got his birth certificate and FedEx-es the packet to me

07/25/2008 mailed DS-230

08/05/2008 should have a "case complete", but NVC is IDIOTIC and has out-of-date info

09/ --/2008 call embassies, change foreign policy

10/02/2008 CASE COMPLETE. FINALLY!

11/??/2008 interview

11/??/2008 disgust strangers in airport by making out with my hubby

They forward both to NVC, the I-129F will pass through NVC fairly quickly, the I-130 will go through the CR-1 process at NVC.

Many keep both petitions going, and respond to the CR-1 paperwork from NVC,and if it the I-130 reaches consulate while they are working on the K-3, the consulate will drop the K-3 in favor of the CR-1 which is the superior visa. Others get K-3 interview rescheduled if it looks like the I-130 will make it to consulate shortly after the K-3 interview date, so that they can do the CR-1.

CR-1 has the benefit of green-card upon entry, NO AOS required, CR-1 also costs less.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

In most cases CR-1 has been taking about the same time to process as K-3.

If your I-797c (NOA2) for the I-130 reads that your spouse is in the US then the I-130 was held for Adjustment of Status. Otherwise the I-797c (NOA2) for the I-130 will state the petition was forwarded to the NVC.

Actually, you were given a choice at the beginning of the process. Just filing the I-130 is the choice for petitioning a CR1/IR1 visa. Sending in the I-129 is the choice for a K3 visa. If you are given a choice after approval, you are one of the few fortunate filers.
