I am planning to do the AOS but my husband and I were no idea on how to start it.

I had my vaccination last week which is the Tdap and HPV and dont know what to do next.

Can we start the AOS now or will i still have another vaccination.

And also, I went to the Social Security Office yesterday and they told me they cannot give me Number without the EAD. :unsure:

Dont know how to get EAD too. :crying:

A k-1 can apply and receive a SSN until day 76 of entry into the US.

Read the AOS guides first... it will answer many questions..

If you are married you can apply for AOS as soon as all evidence has been gathered

With a husband, they have to be married, least by definition. One of you has to be a US citizen or a lawful permanent resident, are you both in the USA?

That is possible if one of you are here on a tourist visa with a current I-94, the latter can be extended by the way.

The forms are the I-130 for the USC spouse or LPR, I-485 for the immigrant, spouse has to do a I-864, both of you have to do a G-325a, Immigrant has to do a I-693 with a USCIS approved doctor, he will tell you what shots you need, and a I-765 for the employment authorization that also let's you apply to the SS office.

All of these forms have to be filled out with required evidence and sent in at the same time, have to be very careful on errors or omissions, they can keep your fee which will really add up and reject you.

And with the new Adobe Acrobat reader ver. 8, that is a free download, can fill in the forms and save them to your computer, couldn't do that last year, needed to buy the expensive version to do that. Can hire an immigration attorney to check over your forms, or go to the suggested other sections for help with some of the questions. We all had questions.

Hi I am Glaiza's husband.

The specific problem that we are having is that the local doctor will not sign off on her medical/vaccinations until she redoes all of them. Apparently, the medical center in Manila signed off on her vaccination with out giving her all of them.

The local doc says that it will take at least six months to do all of the vaccines! Obviously Glaiza's visa will have long since expired. I called USCIS today and talked to a woman named Wanida (sp). She told me that as long as we have records of the vaccinations as they are taken Glaiza will be safe from deportation. However, she also said that I can not file any paperwork (AOS, EAD, SSN, etc) until the vaccinations are done.

Is this true? Is there some way I can at least get my wife an SSN? Wanida told me I need to call the State Department for more information about the Visa status, which I will do tomorrow [Friday]. Has anyone else been in a similar situation? Any assistance will be greatly appreciated.

If she has her K-1 visa and it is more than 2 weeks until it expires she can get her SSN now. She will need to get it in the same name that is in her passport and her visa as that is the name she has on record with USCIS.

She should not have to 're-do' vaccinations she already has. She does need to have all of the vaccinations and be able to prove it to file the AOS. How does the local doctor know they signed off on her vaccinations without giving what she needed? Does she have records of her other vaccinations? She only needs to have what she lacks. If she has had certain vaccinations in the past she can get a titre test down that will show the antibodies in her blood proving that she does not need to redo them. It was also my understanding that they just need to 'start' the sequence of vaccinations, not necessarily have finished them for her to apply. You may wish to find a different Civil Surgeon who is more willing to give just the needed vaccinations rather than giving unneeded vaccinations and charging you more money for them.

As well - the number you called that is listed as USCIS is NOT immigration - it is a call center manned by minimally trained non-immigration people following a script and they more often than not do not know what they are talking about. The Call Center is actually called the Mis-Information line since they so habitually give out wrong information. Your wife's status WILL expire with her I-94 unless she has filed for her AOS - having proof that she is undergoing vaccinations will not keep her safe from deportation although it is highly unlikely that USCIS will take that action so early. That was a dangerous piece of mis-information the misinformation line gave you. If you have concerns about when she can file the AOS, make an InfoPass appointment with an actual immigration officer at your closest USCIS office instead and get the true story from them. You won't get it by calling the Call Center number. In the meantime, apply for her SSN and get the process started.

She can't file for the EAD until she files for the AOS, but she CAN get her SSN before her EAD. Follow the links given by other posters above and go back to the SS office with printed information that shows K-1 applicants are eligible to get a SSN.

Thanks for the quick reply and info. I posted to the forum because I seriously doubted the competency of Wanida when I talked to her. I guess this confirms it.

Glaiza only received Td and HPV vaccinations from the medical center in Manila. The rest they marked as "Not Age Appropriate" The Civil Surgeon (CS) we went to said that she needed to see some record of the other vaccines which Glaiza does not have. I will schedule the titre as soon as possible. My insurance covers 100% of required vaccinations so we are okay there.

As far as the appointment, do we have to go to the regional office in Texas or is the local one here is Kentucky(Louisville) sufficient?

Finally, is there a complete list of all required vaccinations for the AOS, the list from Manila has items that the CS says are not required but is missing some that she thinks are required. Do you know of a definitive list? As far as I know this is the only thing delaying us from AOS.

You can make the appointment at your local Louisville office. You can actually make the appointment online at www.uscis.gov - on the far right hand side it gives you the option to 'schedule an appointment' - that is the one to click on.

Sounds like I-693 problems to me with two factors, first is knowing about the I-693 process well in advance, actually the entire immigration process is helpful, was way too much for me at the time, seems a lot simpler now, but I hired a highly recommended family immigration attorney, got guidance, and sent a copy of the I-693 form and instructions to my bride to be and she had a daughter. She was able to gather both hers and her daughters medical history records from her medical provider, in particular there shot records. And also get those vaccinations required by the I-693.

The second problem was finding a good USCIS doctor that knew the law, a lot of these jokers wanted to go way overboard, when I hear a medical provider tell me they have their own procedure or want to repeat shots to be sure, say thank you, hang up and go to the next one on the list. Actually had to drive 300 miles away to find a good one. Was paying out of pocket for this wasn't married yet, and received quotes of anywhere from 600 to over 5500 bucks for filling out this form. Yeah a doctor is like anybody else and in the same class as an attorney, can't be afraid to find out what they can do and how much they will charge.

This is from the I-693 instructions:

"By law, the required vaccines include: mumps, measles,

rubella, polio, tetanus and diphtheria toxoids, pertussis,

influenza, hepatitis B, haemophilus influenzae type B,

varicella, pneumococcal, rotavirus, hepatitis A,

meningococcal, human papillomavirus, zoster, and any other

vaccinations recommended by the Advisory Committee for

Immunization Practices (ACIP).

If you never received or are unable to prove you received

certain vaccines, the civil surgeon can administer them to you.

After evaluation by the civil surgeon, you also have the option

of asking your family doctor to administer those vaccines to

you and showing the records to the civil surgeon to note on

Form I-693.

NOTE: Please do not attempt to meet the requirements before

you are evaluated by the civil surgeon, in case it is not

medically appropriate for you to have one or more of the

required vaccines.

If you initially did not have documents proving you received

all the required vaccines but later submit those documents, or

if the civil surgeon certifies that it is not medically appropriate

for you to have one or more of the missing vaccine(s), USCIS

may grant you a waiver based on the civil surgeon's

certification on the vaccination supplement.

HHS has determined that a vaccine is "not medically

appropriate" if : (a) the vaccine is not recommended for your

specific age group; (B) there is a medical reason why it would

not be safe to have the vaccine (for example, allergies to eggs

and yeast, pregnancy, hypersensitivity to prior vaccines, or

other medical reasons); or © you are unable to complete the

entire series of a required vaccine within a reasonable amount

of time."

As you can see from the instructions you are permitted to have a waiver.

What I did was fill out the top of the I-693 using Acrobat, clean, readable and accurate, no sense in paying a doctor to fill that out and made several laser printed out copies in case the doctor may an error. Organized the tests and vaccinations according to the form. Doctor said he never had it so easy, still wanted to examine my wife and daughter, but we were in and out of there in about an hour and he still got 700 bucks.

Just sounds like to me, you should find another doctor.

Hello charramal,

When we did our AOS, we went through the same experience. We called USCIS a "hundred" times but none of them gave us a definitive answer. It was very confusing. So, we shopped for USCIS doctors around Albany, NY and we found one at Albany Medical Center. They told me I have to redo everything or they would not do it. So I did all of the shots/vaccinations all over again to expedite filing of our AOS. They have all the forms in their clinic and all I had to do s sign them. Then, when the results were ready after a period of time, they handed me a sealed yellow envelope containing my medical records to be send to USCIS with my AOS. Do not open the envelope.
