Regarding I-864EZ

Hi all,

We have a small confusion regarding I-84EZ.We are adjusting based on marriage. My wife who is a retired person earns from State Teachers Retirement Pension approx $16,354(mentioned as Taxable income) .She also has a counselling business which though runs in a loss but she e arns something from it ; $4,500. We are filling up the I-864EZ but dont know which pages of form 1040 to photocopy and give with it . As far as i know the incomes tobe shown are before tax deductions. I am giving one year as example :

One the form 1040 1st page the Taxable income mentioned is $16,500.Then there are several pages ......... then in Schedule C form 1040 Profit or Loss from Business ..... its mentioned Gross Income $5000( this is from her business) . So the addition comes $21,500( above poverty level).So shd we attach only these two pages or the whole 5-6 pages of the 1040 ??

Can someone advice , we are bit confused ??

i got the reply to all my questions by Iming YuandDan. I am still confused whether we are above or below poverty level. The recent 1040 says

the Taxable income is (16b) : 17,101

Business Income or loss 12(attach schedule C). : 266

This is your total income 22. : 16,863

in Schedule C form 1040 Profit or Loss from Business ..... its mentioned Gross Income $5000( this is from her business) .

BUt we were assuming that in I-864EZ we can add 16b / 22 + the schedule C amount making it like 21K.

what is the amunt we shd put in 864 form as current income ?

I would put the total of $ 21,500.00, and make a copy of the entire 1040 showing how you got to that amount. Include all W2's and 1099's (if you have any) or better yet, get the tax transcripts from IRS, you can request them free of charge.

I had a talk with my tax consultant this morning.She said the income frrom business wd be considered extra income and as the expenses for thehats business is more thats why I am writing those off and dnt have to pay any taxes for that.

Now in the I-864EZ there is a column " My individual annual income is currently " .......... I am writing the additon of the adjusted gross income and my business income which is 21k.

BUt in the three columns I have to write the tax year and total income .The current year is 16,899.

So i cant understand whther i wd be considered under poverty level?? In that case shd i use I-864 adding extra assets etc ??

As far as i can understand that as we are using two sources of income we wd have to use I-864 instead of I-864EZ.

Now things I am puzzled is

a) In I-864 can the income shown Line 23 & 24 differ from the income shown as Recent Tax year Total Income ( in 25) ..... as in line 23 & 24 I am mentioning the addition of her business income before profit or loss (from schedule C of 1040) and adjusted gross income from 1040 1st page.

But in the recent tax year income i am mentioning the gross adjusted income from 1040 page 1. Is this ok ??

B) also if we have to add some asset............. we have some 4 garveyard plots , which as the cemetary assiociation said wd value approx $6k. We are showing tht as asset. Now what evidence wd we need to include ?

wd a letter from the cemetary organisation stating the price and the deed wd do ??

may be its complicated but I think i can expect some experience from someone who has shown assets if their 3 tax yr income is below poverty level.

a)we have some 4 garveyard plots , which as the cemetary assiociation said wd value approx $6k. We are showing tht as asset. Now what evidence wd we need to include ? Deed on her name & authorised letter from cemetary authorities claiming the price of the land wd do ??

B) we also have some jewellery in bank vault.Now these were valued in 1981.wd that valuation do ??It was valued by the manufacturers.

According to the form I-864EZ instructions:

If 1040/1040A was filed for taxes, you use total income (line 22) rather than adjusted gross income.

If 1040EZ was filed for taxes, you use adjusted gross income (line 4)

Your current income comes from line 22 of the 1040 but you include the full tax return plus any W2 or 1099 forms, just as you would if you were mailing the return to the IRS.

For assets to be considered, you must use the I-864. Yes, each three dollars of liquid assets can replace one dollar of income shortfall. If there are sufficient "liquid assets" without using home equity, that would be best, otherwise you'll need to show supporting documentation for the home's value and mortgage balance.
