I-864, Can I used old one or new one for AOS interview?

hi VJ friends,

my wife's AOS interview is only 2 days away from today.

there is a little thing I couldn't get through ..which is I-864 (Affiidavit of Support)

here is the thing: I filed I-864 for my wife in 2005 which included all 3 years tax returns (2002, 2003, 2004). Since 2005 tas deadline is April 15 this year and I didn't not file it yet. So, can I use form I-864 from last year for her interview? include tax forms 2002, 2003, 2004.

or should I get a new I-864?

I am not doing a new I864 (interview on Feb 17th) as none of the information has changed. Yes, I am making a little more money but essentially everything is the same. I had submitted the I864 in October and I will take the copy of the new tax return (2005) with me but I am not redoing any of the documents. Good Luck

Sounds like you are OK on the tax returns. You should bring a current letter of employment or some recent pay stubs.

If your income has changed, you should bring a new I-864.

our interview is on the 15th and just to be on the safe side I am preparing a new I-864 with 2005 tax info, my updated job letter. Note it says on the paper I-864 (unless already submitted). to me this means they will take the one we submitted last year just as they should use the medical and vacc from the ones already submitted. But you never know if they will make a big deal of not having a current I-864 so getting a new set will not hurt at least to us....

The different district offices often have different procedures including sending out different instructions on their notices. So the instructions in your DO may well be different from instructions in another DO. Dontcha love USCIS?

We just had my wife's AOS interview last week and even though the income has not changed and I have not yet filed my 2005 return I gave them a new I-864 with an updated letter from my employer and newer pay stubs showing the continued salary since the initial I-495 filing. The case officer noted this was appreciated, and actually pulled the old I-864 out of the case file and gave them back to me and inserted the new I-864.

It seemed that having everything updated and at hand to present when asked set a good tone for the interview and things went very smoothly. The case officer commented that they really appreciate organization.

The answer to the OP's question is yes, you can use the paperwork you submitted. If between now and your interview (I know it's two days, but bear with me on the point! :) ), you do file your 2005 taxes, take a copy of that with you. If anything has changed in regards to your I-864, take copies of proof along with you. We took an updated employer's letter, which detailed Jerry's raise that kicked in after we submitted our forms, and his new annual salary -- the officer made notations on our original forms during the interview.

I'd prepare update docs just in case you need them. get new letter from employer, updated bank acct info etc. Better safe than sorry!
