How do I cancel a just filed AP application

Timeline

We just filed an AP application because we've been waiting for an AOS interview for a long time without any notice. But a few days later we received an interview invitation. So is there a way to cancel the AP application? They haven't charged our bank account for the check yet.. also, if they do charge it, is there a way to cancel the charges?

You shouldn't have had to pay anything anyway as there is no fee for the AP after you filed the AOS if you sent the AOS receipt notice with the AP application.

If you applied before July 30, 2007 then I'm wrong.

If you applied before July 30, 2007 then I'm wrong.

We did file before July 30.

I guess you could cancel the check but I myself would be afraid to do so. Never heard of USCIS giving refunds. Similiar thing happened to me as I paid $830 for I-130s [CRs] and ended up going with the K3/K4. Had to "bite the bullet" and let them have it. Ouch!

We did file before July 30.

You wont be able to cancel your application for AP but either way you haven't had your interview yet and you don't know if your approved so you still may need you AP.

Jan 9th 2008 Biometrics

Jan 29th 2008 Missed telephone call from USCIS

Jan 30th 2008(my birthday) Returned phone call from USCIS AO (much nicer then original) personally called to confirm my mailing address an advise I am approved an will recieve 10yr card as I have been married more then 2yrs.

Feb 11th 2008 10yr greencard recieved in the mail with wrong info on card.

Feb 12th 2008 Start planning trip home to Australia

May 3rd 2008 Leave for Australia

May 5th 2008 Touch down in Australia 1st time since Dec 28th 1995 what a relief.

May 5th 2008 Suprise my grandmother with showing up at her door. Tears all around but well worth it.

May 25th 2008 Say Seeya Soon as I hate Goodbye...Come back to the US and start thinking about when We will wanna go home again.

USCIS does not give refunds of fees paid, and I really think they'd not look kindly upon a canceled cheque.

Where did you find that there is no fee for AP application? I think it is about $300 and I think this fee always applies no matter when and how you apply during the I-485 process. Please correct me if I am wrong and send me some INS link on this please. I would like to apply now if it is free. Thanks a lot.

The AP fee is $305, but if you filed for AOS and paid the AOS fee on or after July 30, 2007 the fee for AP is waived. You can find this information in the instructions for the I-131 AP form. Look at the NOTE that is listed in the "What is the filing fee" section. A fee is also not required for the I-765 Employment Authorization if you've submitted your AOS.

You can find the forms and instructions on the USCIS website under immigration forms.
