i130 and background check

I have just completed all of our paper work to file for my wife we have been married for several months now her visa expired 20months ago and we have been together since the visa expired but married several months ago. I added her to my health insurance with the SSN she has since she has come hee and she is on our lease and all utility bills. I am a natural born us citizen, the paperwork should be fairly quick. And, is it safe to use the health insurance as a form of marriage support. Also, she is 20 weeks pregnant.

On the other hand I have Habitual Traffic Offender will this be considered a bad mark on a back ground check. I was never arrested for it. Neverd had a DUI or anything. Do they check that as a BG check?

Overstayed J1 Visa.

It was explained to me by our attorney, they are looking for violent crimes mostly, assult, domestic violence, burglary....mostly violent offenses, you are not a criminal just possibly a bad driver. :)

She came to the USA as a student in 06/2006 I met her around 08/2006. She lived with me ever since she overstayed her visa. I married her in 04/2008, We moved from Florida to Tennessee in 05/2008 and I am just starting her paper work. I finished the i130 and G325 for the both of us. The current documents I have are, Joint lease with both name, cell phone and utilitybills with joint names and health insurance through the company i work for and has been on my insurance since we have married. We also have a baby on the way she is 20wks. I meet all the requirments for finance documents for the 125% I have numerous photos with her since we have met. I also flew to Ukraine and asked her parents to marry her. They said yes and I have photos with her family in ukraine also.

Should I put the ultrasound photos in with the marriage documents too?

Wait. Did she go with you to the Ukraine? If she overstayed her visa, left and came back you are in for some trouble.

no, she didn`t go with him. how would immigration let her in with an expied visa???

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

Believe it or not, they do sometimes make mistakes at the border. (Thus having a ban for just this type of situation.)

Anyway, you can include the ultrasound if you want. Many people will tell you that a baby is only proof that you had sex once and it is not proof that you are in an ongoing relationship.

I, on the other hand, was a proud parent and included the ultrasound with our package anyway. :whistle:
