Hi All,

I just wanted to do a last minute check to see if anyone has had a simular situation. I was getting all of my papers ready to file for my wife for her AOS and discovered that i don't have the NOA2 (approval notice) for her K-1 visa. According to the USCIS case status page they sent it to me but i know for sure that I never got it. Very strange but my wife was admitted to the US and they never asked for this document. I did however receive a letter in the mail (see below) that appears to be some type of approval. The question I have is has anyone ever filed for AOS using a letter like the on in red below in lieu of a NOA2?

Here is the letter that I received.

Dear Petitioner,

The State Department's National Visa Center has recently received an approved I-129F petition filed on behalf of your fiance. This letter is to let you know that within a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place.

Our records show that you filed the I-129F petition for:

Name of Fiance: (My wifes name)

INS Receipt Number LIN########

(BAR CODE HERE)

Case Number: CDJ#########

The case will be processed at:

Unless you want to pay $340 for a replacement what else can you do?

I-129F approval notice is not required to be attached to I-131 for AP, AP is based on pending I-485, and is processed separately from the I-485.

I-129F approval notice is not required to be attached to I-131 for AP, AP is based on pending I-485, and is processed separately from the I-485.

So do you think that they will process the I-131 without any problem and perhaps just do an RFE for the I-485?

So do you think that they will process the I-131 without any problem and perhaps just do an RFE for the I-485?

The caveat is that if an RFE is issued for your I-485 before the I-131 is complete then the I-131 will stop

Hi All,

I have been so worried about the missing NOA2 for the I-129F that I bucked up and went to an immigration attorney and he said don't worry and then he got online (uscis.gov) and entered in the case number and printed the notice of approval and told me thet it will be 100% OK to use that instead of the one that never came in the mail.

That makes me feel much better (if he is correct)!!!
