Hello all....

Has anyone applied for a K3 extension while 485 is pending? If so, I'd like to know how long does that take to get approved and whether it's pretty easy to get one or not.

My wife's 485 is still pending and her K3 expires in October. Any ideas or thoughts would be appreciated.

Is it the visa or I-94 that is expiring? Probably not a lot of difference anyway. I've not seen anybody do this but it certainly is possible. Unless she is working or needs to travel internationally, it may not be necessary. She's got status pending AOS anyway.

That's where the problem is - she is working and also has to travel internationally for medical reasons pertaining to her mom. She definitely will need something to enter back to the U.S. Any other input is appreciated. Thanks for the quick reply...

Did you apply for a work permit (EAD) and the AP? If so when did you applied for AOS. Usually it takes around 90 days from the time you apply to get those and then she can travel freely and work as well without having to worry about th K3 expiring.

You might also want to update your time line, it still reads CR-1/IR-1

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship

She already has EAD valid until October also. No AP yet, we have not applied.

Where would I update my timeline....

Well if she really needs to travel then you might want to apply for the AP then. If she has her EAD she can work until it expires.

When did you filed for AOS?

Did you know that AP & EAD were at no extra cost with the AOS application after July 30th 2007? You might want to check the new fees for the AP on its own.

You could try to extend th K3 although I don't even know if you can do that. Technically it is not necessary since you are AOS pending though.
