I-130 Process time for Vermont Center

Hi All,

First of all I just want to say thank you to everyone who is reading my post. I am a new to this forum so please forgive me if I ask stupid question but I tried to read as much as possible before posting my question here. I am sorry if there are few threads open with similar questions but I am just running out of luck with USCIS.

I got married and filed I130 and got my NOA1 - in 2/11/2008 and since then I have not heard anything from USCIS. I am just trying to figure out if anyone who has contacted the USCIS knows anything about the process. Few months back the process time was August 2007 but now it says July 30 2007? How is that possible? They went back from Sep to July in Vermont ??

I see many people got their NOA2 who applied after me? How? Is my application stuck somewhere or lost ?

I need to know how long it will take before they approve my i-130 and when should I contact them?

I dont want to give you false hope of getting approved anytime soon but it is possible A rough timscale of what i see is 8 to 10 months but if they are all up to date then obviously 6 to 8 months ( thats just for USCIS to approve )...I know the website says that they are working on or before cases for July 2007 but i dont think thats true...they never seem to update vermont I-130 timelines because my husband filed my I-130 in October 2007 and we just recently got approved ( june 26th) I don't have a straight forward case but i dont have a difficult one either...previouse marriages and denied entry back in 2002 so more of my case to look at i guess so if you have a straight forward case i am sure it wont take tool long. There are ppl that filed back in August...sept...oct...nov and dec 2007 that are still waiting for approval but again you might be real lucky and get approved soon and once you do NVC are so much easier to deal with regards to calling and getitng to talk with an operator and they do know thier stuff :)

Hang in there it will happen.....USCIS is the hardest part from then on its all good :) took almost 9 months for my case to be approved

I've been in limbo for 1 year now, with nothing.

At present time there is no immigration. So there is nothing to wait for.

Maybe an overhaul in the department next few years may mean VSC is open for business.

There's no course of action either. Sucks.

My wife filed the I-130 for myself at the beginning of Apr. 2008 and we've heard nothing other than a case number. My wife said somewhere on these forums here someone posted they filed in May 2008 and got approved.

Are the forms really processed in order that they're received? Do some get processed sooner or faster than others? Our case is simple as far as I know.

OUR TIMELINE

2007-12-23 ---------- Proposed - she said yes! :)

2008-03-22 ---------- Wedding date

2008-03-31 ---------- Sent I-130 to Chicago lock box

2008-04-08 ---------- Vermont received petition (NOA1)

2008-11-05 ---------- Case transferred to California

2008-11-10 ---------- Received notice in mail about the transfer. No changes to the online case information.

2008-11-13 ---------- Call to the senator's office to arrange an appointment

2008-11-13 ---------- A few hours later, online case updated to say transferred to California and pending

2008-11-17 ---------- Met with someone at the senator's office -- she is looking into the case since it's now a month passed processing time lines.

2008-11-17 ---------- Senator's office called and said our case will be looked at within the next 60 days

2008-11-18 ---------- Touched

2009-01-13 ---------- Call to senator's office again

2009-01-14 ---------- Reply from senator's office - currently doing "extensive background check" - could take couple of years :(

IR-1/CR-1 doesn't seem to be a priority right now for Vermont. I've been in limbo for awhile now. I decded not to file for a K-3 to save some money once she gets to the US. I think people that file for K-3 will get processed faster since it causes them to check your file. Filing a K-3 may speed up the process but if they approve the K-3 before the I-130 then you will have more paperwork and more fees after your spouse gets to the US.

The processing date serves two purposes -- to state that they still have unprocessed files from that date and to give a ready excuse ("you're not outside of the processing dates + 30 days, so ####### off") when you ask why so-and-so who filed 6 months after you was already approved and you were not.

While you can look at running averages on how long it generally takes to provide adjudication, the truth is that any individual file can fall well outside of those averages. And there's not a whole lot you can do about it until their published dates show you outside their own stated limits. And even then, they can hold you up in other ways.

USCIS should be updating their dates this week. It will be interesting to see if the I-130 date moves off of July '07. (And yes, they can go backward if they choose to do so.)

I was the one who filed in May and was approved. There is no rhyme or reason as to why. No special circumstance. No request to expedite. It seems like they do as they feel it is appropriate. No more. No less. The frustrating part is that filers have no knowledge of where they are in the process. There's simply no way of knowing until, voila, it appears as an update.

our petitions have more or less the same NOA1 and i still havent heard from the uscis . i have given up on it, its been a long 5 months and if they approve it, fine... if not, thats it. those people are very inconsiderate.

I have a dumb question and I have been wondering about this since I read a post by the acting boss with the uscis a few weeks or a month ago. I rember reading in there that only a certain number of visa's are aviable, now I understand the limitation doesnt matter to a family based petition, But could it matter. To all the people that are stuck in VCS hell, are you a US citizen born in the US or are you immigrants yourself. To me it would make sense as to why some people get it fast (being a born usc) vrs one is is naturlized. Don't flame me or hate me, I just wonder if it has any bearing on it at all. Maybe a few could post some details like that and answer these questions.
